Assured shorthold tenancy help - urgent

Hi

2 questions:

Am currently living in a 1 bed flat, contract was an AST with 12 month fixed contract, now been here nearly 3 years so has just rolled on from month to month. We pay rent on 24th of the month.

There is no mention of a notice period in our tenancy agreement, so am I right in thinking I need to give 1 month's notice and that the 1 month needs to be a rental period, i.e if I gave notice today I would have to pay up until 23rd May?

We need to move to a 2 bed and have found one we like - they have accepted our offer (advertised at 850, we offered 825 - landlady is apparently very fussy about tenants so has been empty for 6 months!) but only if we sign contract from last day of this month which would leaving us paying 2 lots of rent for 23 days. I have said we will give letting agent our reply today. I am keen to stick with our initial offer but OH thinks we should offer to pay half rent on the new place for a month or even full if that is all they will accept, which we can't really afford.. I think if she's that fussy she'll wait for us. Any opinions on how to move forward?

    Correct. Though to be pedantic it is a 'tenancy period' not a 'rental period'. Usually the same dates but not always.


    * Ending/renewing an AST: what happens when a fixed term ends? How can a LL or tenant end a tenancy? What is a periodic tenancy?

    A landlord so fussy about tenants that they forego 6 months rent? Tread carefully...

    Well to delve further it's a very nice, quiet block of flats surrounded by lots of beautiful gardens in a private road. Landlady is well off & used to live in flat and is friends with neighbours. Last tenants had a child who was a real horror so she got lots of complaints. She lives abroad & letting agent said they had only been 'actively' marketing the property for a few weeks, but it has been empty for 6 months. It was him who told us she is fussy about tenants e.g she wouldn't rent to sharers in late teens as she would assume they would be too noisy for her neighbours. There are quite a lot of elderly residents I think.

    I have told letting agent I am pregnant and so there will be a crying baby in 6 months and he is adamant this is fine.
