The sellers solicitor has made a funny error.

Went to sign the papers and exchange today and my solicitor descovered something. When he asked for the sellers information and documents etc from their solicitor he sent the previous buyers information and it says that he was paying £125k but the buyer dropped out. Now I'm paying £128k which is 3k more than she was willing to sell for back in November. Obviously I wouldn't make a very good poker player but what would you do now? I'm happy with the offer of 128k but would still rather pay £125k.

Two choices,
one is stick with where you are and pay £128 and have everything done and dusted.
Two is you go back to negotiating and the process is drawn out and potentially doesn't happen ever, or doesn't happen for a while.
I know which one i would choose.0 -
If I was the seller and you suddenly dropped the price for no good reason (ie survey had said a £3000 new roof needed) I'd respond by saying the price is now £130, and simultaneouly insyruct my agent to put the property back on the market.
Conversely, I might agree, wait till the day before Exchange by when you'll have invested hundreds in searches etc and then increase the price.

It was probably based on the old stamp duty situation which no longer applies.
Old rules £125,000 = £0
Old rules £128,000 = £1,280
New rules £128,000 = £60.
The rules changed on 4 December IIRC. That changed the ballgame for properties around the threshold.I am a mortgage broker.
