hi,need some help, took a £10,000 loan from RBS about 5 years ago,was paying it off monthly until i was made redundant.Subsequently RBS started charging more money when i could not make a payment,it got nasty then they sold the debt on.It has now changed hands to about 5 different debt companies and we have been paying them monthly until a few months ago,the last company stopped taking money from our account. Now just got a letter out of the blue from a company called Restons who say they own the debt, and want £10,631.10 now.
I phoned them and was told can i make an offer now,of which i can not,so was told to complete the form they sent me.The whole total is now £11,209.50. £100 solicitors fees and a Court fee of £478.40.
I have not been to Court so find that strange, basically what part of form should i sign? Do i sign the "If you agree with all of the claim and are asking for time to pay?"
Or
"If you admit only part of the claim?"
Or
Counterclaim?
I really am worried as to what to sign,,there is a sheet what i can write in all my outgoings and earnings.I am in full time work,do not own a House,I rent, and have no assets, only other debts.
I have till the 27th April 2015 to return the forms so Restons said.
Any help would be very grateful.
I want to pay the debt, but cannot afford large sums, the last company were taking £20 a month,I know that is not a lot considering the debt, but when you have no other cash, what can you do?

Try not to worry, I suggest you call one of the free debt charities, such as 'Step Change' who will be able to offer a lot of advice on how to proceed and what to sign and how to complete the forms and make them an offer of what you can really afford. They have a free phone number and will have seen many cases like this before so will be able to help.

Does it have a case number on it? If so respond online to the courtDon't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.0

Thanks for the advice, yes it does have a court number on the paperwork,,,can they do that? First i have known of it,,I have never been to Court in my life so find it a bit worrying, not knowing what to expect.
I guess as I don't own a home or have assets than Restons cannot "Rob" me like other poor folk,,but what can the punishment mean for me? Prison?
I have no idea.0 -

Thanks Clive,I can live with bad credit,,from now on i only buy if i have the cash, will never be in a position to buy a house,so that does not worry me either.
To reiterate, should I fill the form for Restons or Online for the Court?
Also,Is it my wages they go by or can they include my wife's?0 -

You cannot go to prison for debt in this country, relax.
You have obviously received a county court claim from Restons, your best bet is to ring National Debt line for advice on filling in the forms.

Yes. With respect to StepChange, they are usually not the best advice service to ask about court claims. In general National Debtline are better in that area.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB
