Doesn't mean you don't have a right to a refund. But if he pursued the cancelled cheque he would win.

Under normal contract law yes. But this whole thing is a bit fishy (mind the pun).

Buyer still has rights under SoG and from his description the goods he has received are not what he ordered and are not satisfactory, so he would normally be entitled to a refund or replacement but has not got any contact details in order to request one. I would certainly have cancelled the cheque if it was me to cut my losses.

I very doubt they will pursue it - they don't sound much like a proper 'business' and are probably aware that the rubbish they are selling at doors is basically a scam. As a selling business they will look a bit silly turning up in court without any paperwork/receipts/evidence of an agreement.

I think cancelling the cheque was correct, given you had no contact details.

This way, you have both broken the agreement.

If they get back in touch, say you will pay once you have received the high quality fish you were paying for.
Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')

No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)
  • Thanks everyone. Its my first time on a forum and you've all been really helpful.

If you are concerned this may come back to haunt you, take some photos now of the 'goods' before disposing of them, just in case you need some evidence to support a complaint down the line.

I'd be willing to bet you'll never hear another peep though.
