Argos faulty item - entitled to refund?

Hi All,
I bought a CD/cassette player from Argos on 1st March. It's chewed up two tapes so far and isn't playing CD's properly - constantly skipping through them. The machine is outside the 30 day returns, (and was excluded anyway), but obviously we're not happy that it's no longer usable.
I rang customer services who were quite pleasant, and they said that I could return it as it was under the 12 month warranty but I would have to exchange it or accept a gift card as I couldn't get a refund. Anyone know if that's correct? It's seems a bit odd that I can't be refunded for something that isn't working!

I think Argos are correct. They could either repair the item or give you a replacement to return you to the position you would have been in if the product was not faulty. Anything above that is at the discretion of the retailer.0

SOGA rules change at the point of "acceptance" of the goods. Before they've been accepted you have the right to demand a full refund. After they've been accepted the retailer has the right to repair, replace or refund and refunds can be reduced to reflect the useage already received.
The SOGA unfortunately is typically vague on when acceptance actually happens and talks about the consumer having had reasonable time to inspect the goods. Generally speaking most interpret this to mean a couple of weeks unless there are exceptional circumstances (eg you buy a lawnmower in the middle of winter)
Based on the fact you have had it for over 30 days you are almost certainly going to be considered to have accepted the goods.
An exchange is an acceptable resolution under the SOGA, they cannot force you to accept gift vouchers though unless you choose to do so0 -
Buy another, put the broken one in the new box and return in 30 days. Play them at their own game!0

Do you have any proof of purchase like the receipt or a bank statement etc? Can't say I've had any issues taking items back to Argos when I've had one of the above.
If you do, just go and see what they say. Can't imagine much of an issue based on my personal experiences. Even without anything you could still go and see if they will do anything.0 -

They may want to send it away for repair, if you don't want this the manager has the power to refund instead, just be polite and friendly.

No he accepts the voucher and buys another with that and then brings it back for refund

I thought the Op said it was excluded form the 30 day returns policy!
doesnt seem much point just to keep getting a voucher0
