Commission payments when leaving my job

Hi.
I have been told that for orders received between now and for three months after my employment has ended, the commission will be split, ie I will receive half the commission. Orders received during the 3 months after I leave will only be paid if there has been a quote before I leave (which is fair).
My question is, is it fair for commission to be split in this way, particularly for orders that come in before I leave?
Background:
I have never had a written contract of employment in over 17 years with this company.
I am payed a decent monthly basic, and earn a small amount of commission on sales of machinery. The commission is paid the month following receipt of payment from the customer.
If an order comes in on my territory, but the machine is to be delivered to another salesmans territory, then the commission is split as the other salesman will be required to provide aftersales and on site support.
Given the trouble my emplyer had recruiting a replacement for a retiring rep recently, I have tried to help by giving them 2 months notice, although I am not obliged to afaik.

going back a bit since I worked in this kind of environment but unless there is a contractual right to commission (ie it's written into your contract specifically) then the company doesn't have to pay it on resignation. The company I worked for didn't pay commission at all to people once they handed their notice in. (And they were usually asked to leave right away).
So to answer your question - it certainly doesn't seem fair in that you've achieved the sales and are not getting the rewards, but unless things have changed in the last few years then the company can pay what they want in commission.
Sorry - probably not what you wanted.fluffycustard wrote: »Hi.

As your basic salary is good and you only get a small amount of commission this arrangement isn't really likely to motivate you to get as many orders as possible is it?
Perhaps you could try and negotiate with your boss as you've not previously had a contract stating these terms - maybe the boss would prefer to increase your commission rate rather than take less orders?I'll never be a Money Saving Expert while my kids are Mony Spending Experts.0
