Is it fraud?

To base DLA forms on your worst day. Somebody on another forum told me i was giving out wrong information and that it should be done on worst day.
If that is the case why are so many people being done for fraud for exaggerating their claims.
As far as im concerned and it also states in forms it should be done on what your like most of the time.

    Around half a percent of people are found as having intentionally mislead on thier DLA claims.
    I would not call that 'so many'.

    It's fraud to mislead in order to gain benefit - just as much as if you hide assets to claim means-tested benefits.

    People should be honest. There is a " sometimes " tick box - so sometimes it's the worst day other times it's not so bad. I've found with my two claims( child DLA and my IIDB ) if you set out the facts and back it up with evidential examples then you have been honest and medical reports will back you up. Of course I'm awaiting on a PIP decision - I might have something else to say then ! Lol

    there is plenty of scope to provide information about good and bad days.
    if you have a varying condition, then to supply only information about 'bad days' is clearly fraudulent.
    i have a condition that doesn't change ( except to get worse periodically) and so i just provide details of what my life is like on a daily basis. if i was only blind on 3 days out for 7 and gave information that stated i was blind every day ... that would clearly be misleading and fraudulent

    This is where PIP and DLA differ in this respect. There is a formula that can be used for those with fluctuating conditions.

    In the case of DLA as regards frequency of care needed (throughout the day/night) then case law says that a period of time - weekly/fortnightly -can be used to demonstrate the frequency of care and mobility needs. A diary is always a good idea to demonstrate fluctuating conditions.

    I was told as someone with varying conditions, to write something like "on bad days, which is x amount of days per week, this happens..."

    DWP have actually written on my award notice that they accept that I have fluctuating conditions.

    Thank you all. I thought it was wrong to fill out on a worst day. Is there any official wording anywhere that states this fact.
    When i did mine i did a daily diary and sent all my hospital letters that back it all up.

    I seem to remember there's a declaration you sign to say that the information you've given is correct. Can't remember wha exactly it says on the information it says that comes with the forms.

    Government figures give 3.3M as the number of people claiming DLA so half of one percent is equal to 16500 and that according to you is only the ones that INTENTIONALLY mislead. Not so many? Quite a lot in my book
