Keepmoat new build delayed by 11 months

Hello,

Last year in January 2014 I went to see a new build house from Keepmoat, long story short, I liked what I had saw and reserved a plot with them consedering that the house that I wanted was not build yet.

On the 25 January 2014 I reserved the house and paid the reservation fee. On this date it was stated that I had to pay the deposit and exchange contracts by the 28 of February 2014. The house would start to be build in March and the completion date was on May/June 2014.

On the 22 February I've paid the deposit and exchanged the contracts.

On the 3 March 2014 I got an email from the sales office updating me and saying that the site manager has advised that the build would start around April time and that it should be ready around October - December time wheather permiting (2014).

On the 20 of July 2014 I received another email from the sales office saying that the build have not yet started an that they were awaiting start and completion dates.

On the 7 of August 2014 I got another email saying that they were still awaiting the build to start and still aiming for March 2015 completion, as I had make a visit one week before and were they told me that there was more delays and now the completion date would be March 2015.

On the 19 September 2014 I've received another email saying that unfortunately March 2015 isn't achievable and that the new dates now are July - September 2015. On this date they offered me another 3 bedroom house that was being complete soon, but I didn't accept as the one that I reserved got a garage and this one don't.

Every 3 weeks since March 2014 I've been going to the sales office asking for updates, since September that I dont really got any new news regarding completion dates and why the building keep being delayed, the only thing they say about the delays is "I don't know why the houses are soo delayed, I've already told the site manager to start building them as the persons are waiting for the houses".

From January 2015 till now I din't got any email or phone call from them regading the delays or the completion date or moving date, so I can conclude that they don't even care about their custumers.

I'm creating this topic to ask for help and what should I do, or which legal rights do I have regarding this situation? Can I clain for something or not?

    Speak to your solicitor about the terms for cancelling your contract and getting your deposit back.

    It's likely to be a "pull out" or "stick with it" choice. There isn't going to be a "stick with it and get some money off or other compo" option.

    I had a similar problem. Was originally told our house would be finished by December - now looking to be in by end of May.

    We had a lot of extras thrown in as an apology - turf, dishwasher, washing machine (both intergrated) etc.

    Would be worth asking for similar to help 'soften the blow' if your still wanting the property.
