Employees not allowed to park in customer car park

Where I work employees have always been able to park in the customer car park. Now a notice has gone up at work saying staff are no longer allowed to park in the car park and have to park elsewhere.

Can they do this?

Some staff start early in the morning when it is dark and finish late at night when it is dark and are now expected to roam the streets to/from where they have left their car.

They can, yes. Is other parking available nearby, could you arrange to walk back to the car with a friend?

Not me personally, but people start at different times so will be unlikely walking with someone else unless they were getting a lift.

Car sharing sounds like a great idea - problem solved!

I wonder if it would be worth looking at planning applications for the organisation. I would have thought that they would have to cover what the employer expected staff to do about parking. (Although business needs may change).

Where I work they closed a car park to expand the factory onto. Additional parking was provided but a bit of a distance away.

There were a lot of people who decided to park on the closer retail park and residential streets, all perfectly legally parked, if a bit inconsiderate for local residents.

Security put notices on offending cars asking for them to be parked in the correct car parks, and eventually, for those who didn't comply, the company started issuing official warnings and started disciplinary proceedings. All with the backing, if not the blessing, of the union.

Do any of your T&C's guarentee staff parking on site? Have they considered late night personal security? Are you're insurance premiums affected? Is there a TU present?

Not always practical for everyone. Might get 5 staff starting same time in morning but all finish at different times. This is not a stereotypical 9-5-mon-fri job.

I could look into this but the local council's online planning portal doesn't have the document from the time.

Nothing in contract or employee handbook (part of contract) mentions anything about staff parking. Just this unofficial notice that has been made and put up on the notice board this week. We have a Union and I'm a member but we don't have a rep at my location.
  • How an employee gets to work is not the issue of the employer, if staff are taking spaces up then customers can't park, pay money and keep the business going.

Unless you have it contractually written down then there will be no obligation for the employer to allow you to park.

Is the car park small or does it ever get full?

Car park is never full so doesn't stop genuine customers.
