Hi
I went bankrupt in march 2009. Last Feb I started clearing up incorrect default dates. Aqua had my default as 15/10/09, not 03/03/09 (br date). After sending recorded letter and id, they wrote to apologise and confirmed they'd fixed. It updated on all my files to 03/03/09.

Now my br and all my other defaults/accts related to br are off my files, except Aqua, who have put it back on again!
Because of their error, I've been turned down for a credit card. I've also been turned down for a Community Acct with Lloyds and HSBC which I really need for a charitable project I'm starting. This has led to several hours of wasted time and stress, not to mention searches on my file unnecessarily.

I still have their letter from last year. What would you recommend doing next?

    How recent is the date now?

    Complain.

    - Tell them that you have been turned down due to their error.
    - That unless they (a) remove the inaccurate default ASAP and (b) compensate you, then you will be taking them top the FOS and ICO.

    If the OP is being turned down for credit because of inaccurate data there is every reason to complain and get this resolved.
  • Just go back around the buoy and get them to fix it.

    Not much else you can do...

    I sent them a letter explaining my position, they have said they will fix, and offered a £50 full and final settlement. I'm still struggling trying to get a community account set up, and have had to delay fundraising until I have an account. Would it be really cheeky to ask for more? I'll be donating whatever they give me to the charitable project I'm starting.

    No harm in asking for the £50 (plus whatever they offer extra) to be made out by cheque to the charity instead of you personally.

    I believe £250 is standard for a DPA breach, but it may be worth accepting the £50, paying it to the charity, and moving on, as they can withdraw the £50 offer, too.

    I didn't know they could withdraw the offer. That's definitely something to think on!

    A high street bank has paid me £600 overall for a similar situation.

    Wrote last year asking them to swap an arrangement to pay on my file for a default so it would drop off sooner. They wrote back saying my account was never with their collections department and therefore my credit file should not be showing any negative information at all. Offered £50 which I accepted.

    Two months later it was still showing so I got hold of them again saying it hadn't been fixed yet. They apologised for the delay, said they'd sort it and offered £250. They later said all negative information had been removed.

    Wrote again earlier this month (at least 6 months since I last wrote) as the information was still on my file. They have now finally removed it and offered a further £300.
    What will your verse be?
