DWP asking for a social fund loan which is 21yrs old

There is no time bar on DWP debts, but you can ask them to 'prove it'.
Some debts have been written off, simply because they don't have the relevant paperwork either.
Write to them by normal post and tell them you need to see copies of all the paperwork, and their calculations.
If you were on benefits, the usual repayment method would have been deductions from those benefits.
You could also contact any Welfare Rights, in your area, for help with this. (Google should provide details of any).

Hasn't the time for 'proving it' long expired?
I understood that you had 13 months - 21 years ago - to ask them to prove it?
Are you suggesting that the DWP should now have to prove the debt which started 21 years ago and if they can't they can go whistle for the money?0 -

No wonder they are having to cut the welfare budget even further with that sort of attitude.
well im sure if the OP was getting over £400 a week in benefits like certain people are they could afford to pay much more back all at once .

disregarding BS claims to what people are getting per week and the welfare system should be cut to the bone or to nothing, (not actually realizing that one day they may need the welfare system) because ofcourse we are all scroungers and lazy and we scrimp off their NI contributions.
The DWP are infact incompetent with admin, My wife took out a loan in 2005, paid it back over 4 months and it was done and dusted.
2011 DWP wrote to us cashing in on the loan that must be repaid from 2005, like many I asked for proof, the sent it, but nothing with repayments on, I specifically asked to have the agreement and any payments made.
so I wrote again, no answer.
so I called, to be told that no payments were made as it doesn't reflect on the system, so asked about what was held in clerical, they said it would take them 30 days to retrieve from archive.
2 months later we had another letter informing us they were taking the money from benefits, I called again on wife behalf, asking where my request for clerical claim notes were, they said no one has actioned on them, but they were requested and awaiting a DM to view them. so I requested a DM get onto it and call me back.
Low and behold the repayment statement was in clerical and had never been passed over to debt recovery. infact they owed us money!. £30.00 for collecting too much.0 -

Immaterial. If you had a DWP loan and promised to pay it back wouldn't you think that that is what you would do?

T would agree that the DWP admin system is in chaos. I have had to take them to a Tribunal for such a reason in the past.
They were arguing that an earlier benefit decision had been revised, yet I had the DWP's submission to Tribunal of 6 years ago that said that they wanted a supersession from the date of the suspension. The decision and the suspension were nearly 3 years apart! Suffice to say I won, but no apology from the DWP or acceptance of an error on their part was received.
But in the OP's case he can't remember anything!!!
Whereas you knew what had happened and proved it. The OP in my opinion is conveniently hoping that the DWP don't have any paperwork relating to the loans which would mean that he can walk away from not paying it.0 -
I cant remember anything form 21yr ago can you? OP needs to be asking is there anything in clerical archive that may reflect a payment, if not, and the records don't go back that far I would not pay a loan they couldn't prove wasn't paid back only that 21 yrs ago there was an agreement to pay it back, it's feasible that it was paid off and records don't reflect it due to poor admin.
upon applying for a second loan if the first loan wasn't paid they are reluctant to offer another budgeting loan until the first one repaid, so again I question why the first loan wasn't highlighted at second loan application! I know why ADMIN ERRORS.

Whatever payments. What concerns me as it was 21yrs ago have they lost a lot of evidence I can only take there word on it.
It's entirely possible that someone would forget a small loan taken out 21 years ago, but what of the one you took out in 2006 ?

Err yes I can. 1994 - I can tell you where I was working, how much my salary was, what credit cards I had, what bank accounts I had as well as a very good idea of what was in those accounts. I relate 1994 to a specific event. 1994 (November) was when I purchased a new business.
The next specific was the car I had. I bought a new BMW 325 coupe M in 1992 - L*** *** and my wife had an accident in it a few months before I bought the business (June 1994). The monthly repayments for the car were just over £500 a month.
So I would definitely know if I had a DWP loan (remembering what I got it for) As for the loan in 2006, that is only 9 years ago.
Sorry but what the poster has said "I have no idea if I took out this loan or paid anything back aleady and no longer have any paperwork." does not ring true with me. Why mention that they no longer have any paperwork for it if they can't remember ever taking the two loans out?0 -

Yes he has - pay the debt that you owe, putting the money back into the system for others that are facing desperate times.
No need to paint a picture. Each year has at least one memorable occasion. Think of that and the rest just follows.0
