I agree.... it can probably be shown that it isn't a 'contrived tenancy'. And it can probably be justified that the 'former owner rule' should not apply as the lady could not afford to keep the house. BUT as GM says, you won't know until it's all done so there is a big risk there.
Selling and renting somewhere else is a cleaner solution.0 -
Sale and rent back is now regulated by the FCA.
Whether this would fall under such classification is a question that should be addressed and certainly not ignored.0 -
Leaving aside the whole "contrived tenancy" thing, you cannot claim HB on a property you owned within the last 5 years.0
