Personal injury against me

My wife was involved in a low speed collision and the other person is taking her to court via no win no fee.
Does my wife have to pay for Injury's etc or her insurance.

    Shauny, first, don't worry if you have told your insurance

    Second, pass all the letters onto your insurance company (I am assuming you told them of this incident and didn't just offer to pay cash for damages?).

    Any collision like this risks a personal injury claim from the try it on border-line fraudsters claiming whiplash for a 5mph nudge that clearly didn't cause any damage - so always tell your insurer, never offer to settle cash

    You pay your insurance for this sort of cover even if the claim is dubious - chances are they will pay out rather than fight it so it will be on your record for 3 years but at least you won't have to pay out of your own pocket

    my wife has forwarded it to the insurance company with a cover letter and has asked for them to check if the other woman was a named driver as her boyfriend is putting in a claim for the damage and her for whiplash. after been passed from pillow to post with our insurance.

    In any collision the legal status of the other driver (or even how they were parked) is irrelevant if your wife ran into them. Even if the woman was not a named driver that does not invalidate any PI claim - it might be a matter for the police if she was uninsured but your wife still ran into them, she was still the guilty party and she is still liable (via her insurance) for damages and PI claims.
