Zavvi product availability

I recently ordered an Xbox one bundle on Zavvi that included two games. The bundle was still being advertised for sale long after I placed my order. It's now shows as out of stock. After waiting over three weeks for them to confirm delivery and being told that the item was on special order with their suppliers they have now advised that they can't deliver the items and must cancel the order. This is not the first time this happened to me with zavvi. Zavvi are still selling the xbox one console and the games offered in the bundle on the site as separate items so they could easily fulfill the order. Is advertising goods for sale that are unavailable an acceptable practice when trading online ? And am I within my rights to demand that they honour the order that was placed. it seems to be a very dishonest way of trading in my opinion.

It's an annoying situation for you for sure, having worked for a large retailer the chances are they were told that they would be able fulfil orders by their suppliers. They will then have been in touch to let them know they couldn't get the stock.
Checking the T&C's on their website it states:
'All orders are subject to acceptance and availability. If the goods ordered are not available, you will be notified by e-mail (or by other means if no e-mail address has been provided) and you will have the option either to wait until the item is available from stock or to cancel your order.
Any orders placed by you will be treated as an offer to purchase the goods or services from us and we have the right to reject such offers at any time. You acknowledge that any automated acknowledgment of your order which you may receive from us shall not amount to our acceptance of your offer to purchase goods or services advertised on the Website. The conclusion of a contract between you and us will take place when we (i) debit your credit, debit card or PayPal account or (ii) dispatch the goods to you or commence the services, whichever is the later.'
It doesn't look they have any obligation to use the stock individually to fulfil your order, if you are really nice to them they may do it as an act of goodwill but if you go in calling them dishonest and trying to strong arm them in to doing what you want you will just !!!! off the customer service rep you are speaking to and probably end up getting nothing.0 -
Zavvi are terrible when it comes to stock.
Often steel books wil sell out so if you end up with a damaged one, your stuck with it.
It's so bad I started ordering 2 so I already have a replacement, just in case.
Then there is the constant swapping between it's out of stock then miraculously back in stock (on top of those copies made re-available due to payment issues come release date.)
Oh and not to forget greed - Aladdin steelbook sold out within days, priced £17.99.
A week after release, it was in stock again at the inflated price of £24.99! On their eBay outlet too mean in they were trying to cash in, scalper wise.
They are n atrocious company, and customer service is beyond a joke.
I only buy from them as they somehow have many steelbook exclusives so unless they don't sell out(and am able to purchase from non-Zavvi ebay sellers at u inflated prices), I'm stuck between a rock and a hRd place ip when it comes to titles I want
I miss the days of HMV and Play.com selling steels. Much better CS, very reliable and better prices.
I"d warn anyone/everyone to avoid Zavvi, maybe using them as an absolute last resort0 -
Zavvi sent me two separate previously returned Xbox 360s as new in the past.
They are, in effect, a scaled up corner shop, and should not be trusted.0
