SCS Sofas Cowboys warning.

In case anyone is looking into getting a new carpet from SCS (and I guess their sofas and beds too) watch out they are Cowboys.
So on Sunday 29th we ordered a new carpet from SCS, we paid in full (on a credit card fortunately) and was given a delivery date for the 14th (notably more than the two weeks they said it would take).
However on the Tuesday evening we had a call from the salesman saying our carpet wouldn't wouldn't be deliverable until the 30th, over a month after placing the order! I told him of course that that was unacceptable and we would be asking for our money back. The salesman insisted that this wasn't possible and that I'd have to go in and choose another carpet.
So the following day (today) we went to the store and after some waiting around was introduced to the manager who proceeded to give the same BS about not returning our money insisting that we could only choose a different carpet.. even to the point of stating that the carpet we originally ordered was available just they couldn't deliver it.
This behaviour is blatantly wrong and breaks several consumer laws as well as their own T&Cs! Thankfully the credit card company are very understanding and frankly couldn't believe what they were hearing, they've since put a dispute on the payment as we are covered by the Consumer Credit Act.
So anything over £100 use a credit card and NEVER use SCS!

What are their cancellation terms and conditions ?
SCS will respond to your card issuer stating they can still deliver the goods so it depends what the T & C's say.0 -

Did you notice I used the word estimated a few times there?
Whilst SCS don't use that word, their Delivery terms say:We'll fulfil your order within the relevant delivery lead time (in days or weeks) we agree with you. However please note that all delivery lead times are approximate only.
Ok, I concede that revising the estimated delivery date by over two weeks is slightly naughty, I cannot see that you are entitled to a refund. This is simply because all dates that you have been given are estimates.
Unless you made time of the essence, then I am afraid you are stuck with this situation. As said above, SCS will defend their position with your card issuer.0 -
Well the T&Cs are pretty vague but they do state that the delivery date is an estimate and can be a week earlier or 1 week later than the stated 'delivery lead time'. However they also state "In the unlikely event that we become unable to fulfill you order due to circumstances beyond our control for example, due to the action or inaction of one of our suppliers, we will notify you that the contract between us has been cancelled and we will provide you with a full refund..."
Theres nothing about offering an alternative product in the event they cant fulfill the original order, and as far as I can tell they cant honour the contract on time... I'm sure they can argue something using the vagueness of the T&Cs and lawyer talk but the credit card can deal with that!0 -
When we went in to SCS we stated on MULTIPLE occasions that we needed the carpet within a tight timeframe and were told that it wouldnt be an issue and the carpet would arrive on the 14th for delivery to us, giving them just under two weeks. They have now revised this to over a MONTH away, 32 days to deliver, with or without bank holidays this is an extremely long time frame for a supposidly IN STOCK carpet.0

SCS will tell your credit card company that they can still fulfil your order, your credit card issuer will come back and tell you that. You will only get a full refund if they are unable to fulfil your order, as per their T & C's
If you think they've "broken" consumer law and breached their own T & C's then you need to go back and prove that. Your credit card issuer won't be arguing with them about consumer law.0 -

I couldn't see that "can be a week earlier or 1 week later" anywhere though.
Good luck.0 -
Just a quick update, have been finally offered a refund after contacting SCS via twitter and thier online contact form. Pretty sure that provided they havn't cut the carpet to your specifications your entitled to cancel, but once its cut its tough.0

I am not overly impressed with SCS myself. We ordered carpets for three rooms, 2 different carpets, with one of them taking 21 days for delivery which was ok for our needs. The wonderful fitted turned up on the planned day but the warehouse had sent the wrong carpet, instead of red, they sent a black carpet because someone stupidly input one digit wrong when ordering it. Spoiled our planned family Easter as we had no carpets down until SCS could arrange to get the correct one delivery which they did do within 5 days and over Easter so fair enough to them for doing that but mistakes like this really should not happen.0

Off topic! But please use a small local carpet shop that relies on reputation! I've never found them any dearer than the big boys and the service has always been great.I'm never offended by debate & opinions. As a wise man called Voltaire once said, "I disagree with what you say, but will defend until death your right to say it."
Mortgage is my only debt - Original mortgage - January 2008 = £88,400, March 2014 = £47,000 Chipping away slowly! Now saving to move.0 -

We use to, but in my town they have all closed. One we used for 30 years in a warehouse with an independent DIY joining it closed and now the warehouse is apartments! We had a choice of SCS or Carpet Right.0
