living in a close

hi
we bought a brand new house in a Close last year since then they have started a new phase of building near to us but have opened up the road so that there are openings at either end (hence more traffic).this will make it uncomfortable for us due to the fact that the cars that will now be coming up will be shining there headlights into our living room . the sign at the first opening shows a T which indicates no through road .
does anybody know if we have a legal case of being misold where we thought we was moving into a cul de sac . when we brought the property we did ask what was going to be built near us but they declined to comment .

    Doesn't sound like they lied to you, they just didn't tell you. I've seen it before, with people who've bought a house backing on to fields only to find a year or two later that it was about to become a housing estate (apparently there'd been a verbal assurance that there'd be no development for ten years, but she had nothing in writing). I don't think there's anything you can do about it when all that's happened is that you'd made an assumption.

    It's a bit late now, but it's possible that you could have found out what proposed building was in the pipeline if you'd done your own research - it's unlikely that it hadn't even been contemplated twelve months ago - at the least you should have pushed them for a straight answer to your question, since I guess it's now all too obvious why they didn't want to reply and a more experienced buyer might have heard those warning bells. You live and learn, sadly. :(

    Just one of the nuisances you have to put up with. we are at the bottom of a close right in the middle of the T. Its only a small close of 11 houses.


    Therefore at night every car coming into the close shines headlights on out bedroom ceiling.


    There are no street lights so its very noticeable. Worst are the taxis which come to the bottom, pull up outside our house with the engine running and lights full on while they get paid then do a 3 point turn to leave.
    Its just great! We rent and I'm so glad we haven't bought here.

    If it's dark enough for cars to be using headlights, could you not just draw the curtains?

    I can think of some houses near me that were built a few decades back and the owners of them would have thought they were in a cul-de-sac. But, I imagine the road came to a dead-end - with nothing on beyond it except a field.

    You guessed it. It took a few decades but there is quite possibly still some of the original owners in those houses and that field has now been built on.

    I think its probably only possible to think "That's it. The road is safely a cul-de-sac okay" if the end of the road has a house/houses built on it. Even then....if there's a field beyond then never bargain that one of those "end" house owners mightn't sell up at some point and their house get demolished and used as a "building plot" providing access.

    This is not a case of mis-selling, since no undertaking was given that the road would remain as it was when you purchased.

    The the road sign is now misleading, but the information you were given, was not.

    ...always worth trawling through the local authorities planning application enquiries. I searched back 5 years close to a house - and withdrew the offer!

    It is usually obvious when there is going to be a through road there will be a gap in the plans.

    if they don't plan to have a through road they build a house.
