UN ethical parking mis management

Hi all !

So looking for alittle advise, read stickies on newbies and about to send template letter off HOWEVEER..

My story in brief .
i was working in block flats controlled by EPM.
I had permit to park, had permission from management and was working for owner of flat of which car parking area belonged too.
however last day of my 2 weeks work my ticket fell from dash..boo hoo.
I found then end of day their little treat stuck to my window
, this was in AUGUST 2014.
In my stupidity i quickly wrote a rant letter outlining my right to park there, included a photo of my permitted and named the people who gave permissions. posted recorded delivery .

I received NOTHING in correspondence since not even acknowledging my letter.
NOW 27/03/2015 today 8 months on i receive the "Notice to driver", still with no ref to my prev letter.

I read that they have max 56 days to send this Notice out and clearly they way over this.
the question is do i now continue with template letters as found in stickies acting as if i never even sent letter. ?


do they have a leg to stand on being soooo long after actual PCN was stuck on my window..

    they have 6 years to pursue an invoice under the small claims court procedure

    the term you are referring to is due to POFA2012 but as you outed the driver its irrelevant (shame but true - so its that part you misunderstood as it refers to the NTK)

    just send off the template letter with free proof of posting from the P.O.

    you quoted 56 days, that is referring to the limit for an NTK for them to claim POFA 2012 applies

    you outed the driver by appealing straightaway, so negating any chance of hiding behind POFA 2012

    as you appealed and so cancelled out POFA 2012 , you cannot complain if it took longer than 56 days because they have 6 years , almost 2000 days, to pursue the driver (who you outed by immedaitely appealinjg)

    in simple terms, you cannot quote terms from POFA 2012 when you appealed as driver, (not as keeper to a postal NTK)

    this is the reason why appealing to a windscreen ticket is stupid, as it means POFA 2012 is no longer applied

    Thanks so much for this response, makes sense now. been away on holiday so sorry for late reply.

    As it stands though they have never acknowledge the letter i originally wrote (appeal) So do you think its still worth sending the Letter referring to the POFA as if i have sent nothing (perhaps they never got letter so know no different)

    they have 35 days to consider your appeal , some take even longer than that

    as I said earlier, by outing the driver POFA does not apply, so no point in making reference to POFA when its irrelevant

    So update. Sent letter. They replied stating we acknowledge your appeal (NOT MY FIRST LETTER, THIS IS THE TEMPLATE LETTER FROM HERE) and expect to hear from us in 35 days plus. BUT also got at same time a letter stating you have 20 days to.pay or debt collectors taking over and will incur more costs....

    Any recommended thoughts. I will search forum further as to next move...Thanks so much for your help.
