Parking Eye court case
Roki
Hello there, hoping someone can help/advise.
Following quite a lengthy drive during which I felt absolutely shattered, I pulled into a Motorway Services supposedly for a 10/15 minute rest.
Unfortunately, I shut my eyes and woke up freezing 6 or so hours later at which point I continued my journey.
I then received notice from Parking Eye of a £100 charge for overstaying which I ignored following the advice of a Radio Lawyer who said that these are seldom taken further due to cost. Parking Eye have now begun proceedings to which I submitted a defence along the lines of the fact that £100 is unjustifiable. They intend to continue and have refused mediation.
Can this be challenged or am I better off just paying up and forgetting it. I would rather the challenge option if there is one.
Thanks

Land Registry, find the actual land owner and check against the contract they have redacted.
Look very carefully.
Example Dodgy services LTD on contract.
Dodgy services incorporated trust LTD as land owner.
They are leased and most are off shore for tax purposes and sub let to a similar named operating company.
If the contract is with the operator as opposed land owner then you have themI do Contracts, all day every day.0 -
Insufficient info. from you o.p. - no dates, p/w specifics - and insufficient reading by you, but Welcome to the Forum.
I saw 2 of these off last year - identical reason, Parking Lie, but getting stuck into reading will quickly tell you mitigation is not grounds for Appeal, only ballast.
You must read the stickies thoroughly and Parking Prankster's blog:

Download a copy of Parkingeye v Cargius case which shows that the loss should only be the unpaid parking fee which is normally between £10-£15 at a Motorway service station.

Let's wait until we have accurate timeline/update from op. on p/w, happy reading though that case makes.
We know parkinglie won't mention Beavis and Judge has to eat his HC buns and choccie eggs before that decision arrives.CAP[UK]for FREE EXPERT DEBT &BUDGET HELP:
