Sorry but I've replied to so many WP threads over the last couple of years I have stopped endlessly repeating the same information.
WP have not sought to pursue keepers for some time now and therefore do not seek to make use of the provisions contained in POFA. From that perspective the "relevant land" argument is somewhat redundant. I have not researched in ultimate detail all of the various locations they cover but in a reasonable number the housing stock and land on which it stands had been handed over to the arm's length company, negating the traffic authority aspect (albeit that they are not using POFA) - and, it would seem, the DfT directive from last year that LA's should not be attempting to use contract law to enforce parking (a la Wycombe). Th LA may well have an interest, perhaps even a controlling interest, in the arm's length company but that does not turn the ALC into the LA.
Hi, sorry this is all a bit confusing for me. What does this mean for me, can I still win at POPLA?0 -
If you have a POPLA code, yes. So use it. Just stick to the tried and tested arguments (signage, GPEoL, standing, etc.)0

You could alter it slightly to make them aware that they are acting as agents and you may also hold the principal liable for your costs - also fire it off to the principal ( whoever hired wing parking ) and let them know that unless they call of their agents you will/mauy be holding them liable for their agents ( wing parking) actions. From the Plain Language Commission:

also, I wouldnt be using their appeals form would I?
So just send an email, as they say you need to say who was driving, but am I right in saying I SHOULD NOT do this and should stick to the template?0 -

Ok will try put this in somewhere. To me it is like reading a another language, makes me feel really dumb!!
Also do I just add at the bottom, if you reject my appeal, then please send me a POPLA code?0 -
Another thing worth thinking about is changing the word appeal to Challenge - an appeal is something that you would do the the local authority if you had a parking fine or penalty .
Wing are not an authority, and as such it could be said this is not an appeal.
it is either a challenge to their invoice, or a statement telling them that you are not paying their speculative invoice. From the Plain Language Commission:

Hi, I sent the First Stage appeal off on day 21 as advised.
I sent it via email and received a confirmation email to say it had been received by Wing.
But that was on 14th April and I have not received an outcome from WP yet. Any ideas what I should do?
Help is appreciated..as i am not sure if I should contact them or not?
Thanks0 -

Same as any other Wing case, the OP will have to jump through two appeal hoops before getting the POPLA code. Just do it and get there (not saying who was driving even if asked in a letter) and win at POPLA.
I have sent off the first stage appeal to WP. I sent it via email and received an automated message to say it had been received and would be dealt with within 10 working days...that was 14th April.
Should I contact WP and ask about the appeal or just leave it? If they did reply and rejected the appeal, I then would have had to appeal to Islington Council before receiving a POPLA code, so am unsure what to do.
Your help is much appreciated.
Thank you in advance0 -
They have 14 days to acknowledge your initial appeal (which they have) and 35 days to accept and cancel the parking charge, or reject and issue a POPLA code. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Hi, is it 35 days or working days?
I sent it off on 14 April, the sent a generic email the same confirming receipt of my appeal.
Its now been 34 days, so they have until tomorrow to respond.
What shall i do if I do not hear anything? should I contact them and chase it up or leave it.
Many thanks0
