Issue with our landlord

    Pick one then. Stay in the property that's has an on-going damp problem for 6/7 months with the LL who has shafted you out of 2 months of fixed tenancy, or move.

    Well clearly I will have to pick one and when the tenancy comes around we will make a decision then.

    You go on like I did the tenancy on purpose. I didn't realise.

    No, I'm having a go at your LL for shafting you.

    Your LL hasn't fixed the damp problem and is at best clueless about fixed term and SPT or at worst did it on purpose. It's not the sort of person I would want to hand money over to every month.

    At the minute we don't have a lot of choice as we are paying a few things off this year which also end this year.

    Next year we will be in a better position to move out.

    Unfortunately you have relatively few rights. You are now stuck in the house until July if I understand correctly. You can attempt to go through the process to get the repairs done but I fear you will run out of time. Let's say you wrote to him, got no reply, got the quotes, got no reply and then got the work done. At this stage you may then not have any rent payments left in which to recoup the money. It's probably not worth the hassle :(
    Good luck if you do decide to go down this route. I think it's unfair that landlords can, and do get away with this sort of behaviour :(
    Another route to go down would be getting environmental health at the council involved, but again, unfortunately this can take time.
    I would say though to make sure it is all clearly documented (as you don't want him trying to take your deposit) (lots of dated photos, with the days newspaper in shot if possible), and put your complaint in writing, if nothing else to protect yourself from any future claim he might try and make from your deposit.

    Well, yes, quite, moving a partner and child is not easy. There may not be many suitable properties. The op has explained they are currently paying off debts and may therefore have difficult with credit checks of with providing a deposit. I assume it's perhaps not that easy, unfortunately. Of course moving is probably the best long term solution if one can afford it.
