    Yep, read what's being said on Rachieb77's thread which was perhaps the first one to get several opinions today.
    Also they included a photo of a sign giving a different amount of money that would be charged, so will keep that on record if needed later.

    Now is that 'need it later' rainy day! Quite rare to see that from ParkingEye and you NEED it. :D Is it a £90/£100 discrepancy?

    Get that out and dust it off and make it clear that the evidence fails to show that a contract was capable of being agreed for the sum on the PCN, because at least one of the signs does not even state that figure (tell them which sign or attach it to your email/contact or embed it into your word document of comments). As such, regardless of other signs that may not ever have been seen (and there has been no evidence as to where the car actually parked in relation to signs) this case is not comparable to the Beavis case in any way which can favour the operator.

    Do not expect WH to do this for you. Spell it out. No contract for £x if a sign in their own evidence pack, says £z.

    And quote the Lead Adjudicator, Henry Greenslade, from 'old' POPLA (Annual Reports) as quoted on Rachieb77's thread, where applicable to what you want to say to Wright Hassall.

    As this is PE I would not argue the Beavis or GPEOL issue further. Particularly if yours was an overstay in a retail park? Choose the part of the battle to fight, not GPEOL probably unless your case was very different.

    Instead, argue about that sign and also if there is any issue with the landowner authority (assuming you included that point in your original appeal). Such as if they have sent an old heavily redacted, blacked out 'contract' dated over a year before, which includes fuzzy wording saying the contract lasts just 12 months...

    Look closely again at the evidence pack. :)

    A few months back right hassel wrote informed me they took over and as the court case lost appeal now to be heard. I didnt respond to the letter. Today, finaly, the email outcome arrived.
    Won on the grace period of entering and leaving.

    When i have access to a pc i will upload the decision letter. There is no names person on the letter.

    So this was WH acting as POPLA? Now known as WHOPLA to distinguish them from the real POPLA.

    Quite a result as many WHOPLAs are going against the motorist - well done. Your upload of the decision letter will be very useful, and gratefully received.

  • Hello, Great news about the grace period as I overstayed for 12minutes and WH has rejected my appeal. It would be really helpful to see the letter - I could not find it so assume that it is on your to do list...
