Selling in Glasgow

Having been on the market for last 7 weeks or so, our house still isnt sold. We received an offer 4 weeks ago and thought everything was going ok but buyers are refusing to sign missives as they have a house to sell. There has been a lot of interest.

We have had to chase and chase them to find out what is happening and their lawyer has had trouble contacting them also. They had a survey done also which all proved to be ok.

The law needs to change to make people commit once they submit an offer, perhaps by paying a deposit within 7 days like high end companies are doing such as Savills and Knight Frank that ways everyone knows what is going on?

Anyone any ideas?

    Is 5 weeks really so long considering it was under offer for 4 weeks? Looks a nice place, although personally I'm not a big fan of 3 story houses or gardens backing onto public areas. In England they could have kept you waiting for months before pulling out.
    Been away for a while.

    if they didnt sell their old house then they wouldnt have the money to buy yours but be legally bound to do so. what do you expect the buyers to do, as it is they have lost out on the cash they paid for the survey.

    im assuming you were aware that they needed to sell when you accepted their offer so them's the breaks, if you need a fast sale then you need a cash buyer, ftb etc and they can command a premium by getting a lower price.

    I do sympathise with this seller (as a fellow Scot). It used to be the case that (20 years ago or so) you had to do a survey before making your offer therefore your offer was a commitment to buy. Once accepted you were buying that house. Everything signed for a done deal.

    Sadly this has been diluted by the amount of offers made subject to survey - which means nothing...

    Leaves the Scottish system as likely to fail to complete as the English imo

    since i have bid and lost 3 houses (1) which have gone to closeing date i think that subject to survey is definately needed. if i haddent i would be down £1000+ in survey fees and im betting that in the 3 houses i looked at have made surveyors over 4k from folk getting surveys.




    (1) all offers well over 20% one by over 47%

    Did the buyers say they weren't proceeding because they haven't sold ?

    what is the date of entry ?

    It's common for solicitors to advise buyers not to sign anything until they have a mortgage offer on the table , many solicitors will use stalling tactics to protect their client from committing themselves. Albeit most sales go through ( in Scotland )

    IMHO the buyers are doing the right thing.

    Why don't you just put your house back on the market?

    Single survey will solve that.

    Thanks for the comments... i just think the government needs to be looking into the whole process of buying and selling particularly around sellers rights.... or lack of them!
