land registry......what's this charge?

Hi, I'm dealing with a house in my Mum's estate, which has this odd charge......
C: Charges Register
This register contains any charges and other matters
that affect the land.
1 The land is subject to the following rights reserved by a Transfer of
the land in this title and other land dated (date removed) 1963 made
between (1)(name removed) and (2) (property company name removed).
"EXCEPT AND RESERVING unto the Transferor her successors in title and
all others entitled thereto such rights and easements to which the
Properties hereby transferred would have been subject had such
properties and the adjoining and adjacent properties been owned and
enjoyed by separate owners in their present conditions for the space of
forty years last past".
Anyone know what it means? Can I remove it? Is it a problem?

I don't recognize the name in the charge. The history of the house as I know it is, it belonged to my Gran, I don't know when she bought it, but she sold it to my parents in aprox 1970.

    It's not a charge, it's something put with the house probably when it was originally built and some sort of right reserved by the original landowner or the house builder.

    If there are details on the title then the Land Registry should have a copy of the document so you could get further details.

    It's unlikely to be any sort of issue that would prevent a future sale of the property or anything like that.

  • Sorry, when I said history, I meant the history of my family's involvement with the house. It's a Victorian house, so it can't be anything to do with original owners, I think?

    More is coming back now, sorry, it used to be 2 flats, my parents bought the freehold and lived downstairs, and when the upstairs tenant died, the whole house became "our house"

    LibrisLycan - as Crabapple posts it is not a charge. It is a general easement imposed in 1963.

    Experience suggests that it should not be a problem but a conveyancer should be able to explain it's importance and meaning from a legal perspective. Invariably such easements are granted/reserved simply to protect a situation relevant at that time.

    Whilst it may be possible to remove, with the involvement of the current owners of the other land/property included in the original Transfer removal is rarely applied for.

    As the extract is set out on the register it is very unlikely that we would have a copy of the Transfer on file
