Court letter need advice please

I posted on here a while back about a PCN I recieved in September. I have received alot of advice privately from a member of the forum here already but things have moved on and it's unfair for me to keep asking for their time, so I'm attempting to resolve this complicated affair on my own.

The story so far.........I received a PCN letter through the post without any evidence or windscreen notice. This letter was sent to my previous address so I didn't receive the PCN for some time. I ignored it on the pretense that in theory I didn't receive it. Then I received a debt collectors letter and came to the forum to see what I should do. With the advice I received, I appealed to BPA aswell as the DVLA to no avail. My further advice was to not worry until court letter arrives, if it arrives.

Anyways obviously I've been sent more letters to the WRONG address. I've had 2 letters from a different company threatening court, the problem is I may missed the 14 days due to not receiving the letters. I don't know the dates as the letters aren't to hand but they were within March. Within this time I received a letter of evidence from Park Direct. Surely I should have received this letter along with the original PCN letter or before?

If you've managed to keep up so far great! How do I move forward now? The private advice I received has advised to use a letter from this forum as a template (can't post the link). I think I'm also going to write to the gym that are on the land presuming they are the landowner and see what they say. My partner was very heavily pregnant at the time. Surely aswell I must have a case bearing in mind I'm technically not receiving the letters. The evidence they sent BPA was flawed as far as I can tell and the photos were taken by an attendant NOT ANPR. Do I also have a case for contesting due to a relative loss of earning for the parking infringement? Any advice would be very helpful so I can close this once and for all as I don't really know where to go and are very confused with the steps to take.

Thanks!

if you have received an actual court letter, where is it from ?

    (northampton or salford ?)

have you checked its validity with the court itself ?

I assume the PPC was Park Direct

I assume this is to do with England or Wales ?

assuming you have a genuine court letter, read the COURT post (post #5) in the NEWBIES sticky thread near the top of this forum, that tells you what to do about genuine court letters

if its not a court letter, it will be some form of debt collector letter, in which case read the debt collector post (post #4) in that thread

I've had 2 letters from a different company threatening court,
Debt collectors? Ignore them - read post #4 of the Newbies thread.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

The second letters threatening court were from zenith collections or something like that. Definitely zenith though. First letter was a reduced offer and second letter was an increase and theat of court plus the cost to be recovered if that was the case. Yes it's England and thanks I'll look at post 4.

That about it I take it?

Zenith is just another name that Debt Recovery Plus use.

They cannot take legal action as it's not actually their debt. If Park Direct ever take legal action against you then that cuts Zenith out of the loop completely, so despite telling you that they will recommend court action to their client, it's not actually in the interest for that to happen. They'd much rather you just got scared and paid them.

I can't recall Park Direct ever taking legal action, they are pretty toothless.

suggest you change the header in post #1 as its a poxy debt collector letter from Zenisth/drp, NOT A COURT LETTER

a court letter would be from the official small claim courts at northampton or salford

Sorry I should've worded it a bit better. It's a threat of court. Ignore or reply? Thanks
