Estate Agent Fees

Just after a bit of advice and other peoples thought's. Signed up with our estate agent fees are 1.25% plus vat to include an EPC and Floorplan.


Offer accepted on house a week after signed up with them and before they had even got it advertised on Right Move or Zoopla. Advised we still wanted it advertised on both in case sale fell through.


Our house was tenanted at the time house went on market and they couldn't arrange a convenient time with tenant to allow someone to go in and do EPC and Floorplan so they have used our old EPC which we had done in 2009 and found an old floorplan online.


Are we within our rights to request a reduction in the final bill from the estate agents seeing as we have provided the above and not they have not had to pay a 3rd party to go into the house and carry out work?

    Surely the time to negotiate the price was before the EA started to market it in any way, not after they had, and certainly not after they have sold it.

    So your house was tenanted at the time they wanted to get in to do a floor plan and could not get in, they used an old floorplan and EPC (I presume until they could get into the property) they still sold the house a week later thus negating the need for the floorplan and EPC, you are now looking for some money off because of this, how much do you think they should reduce their fees?

    An EPC is valid for 10 years so nothing stopping you using the one you have unless you have altered anything eg new boiler, windows etc which will improve EPC. You can get copy online if you havent already, its free just go lo EPC registry and put in you address.

    not looking for percentage decrease just the money back that they would have spent getting epc and floor plan done.

    They both would probably have cost them less that £100.
    You never know how far you can go until you go too far.

    So they have breached the contract. In theory, you can claim for your losses as a result of their breach.

    But in this case you don't seem to have suffered any losses. (e.g. if their breach meant you had to pay somebody else to do an EPC, you could have claimed for the cost of that.)


    To put things in perspective, an EPC typically costs about £50 and I've just seen a UK website that does floor plans for EAs, that says:
    If you send us your sketches then we'll produce the high quality floor plan for you for just £4.50!

    So the sums involved are quite small.

    Thank you edddy that's what I am trying to get at. We asked for a lower percentage to sell but were told they could do 1% but that wouldn't include floor plan, zoopla etc so we said no we needed those as buy to let property which we needed to sell reasonably quickly as we can only afford to support our personal mortgage and the buy to let one for a limited time.

    I didn't realise that both would cost so little, we paid £150 for our EPC in 2009 and was unsure of costs of floorplan.

    It has been an extremely easy sale for the estate agents, our buyer has sold through the same company so I guess I am a little aggrieved by the amount we are paying them to sell our house for seeing as they have done little work - literally take 5 photos and make a few calls, the first to see was the one to buy! But then without them we wouldn't have had our buyer.

    Why is this the EAs fault?
    You were the one that failed to provide them with access to the property.
