Information on Disability premiums

Hi there
I am looking for more information regarding my circumstances
I am registerd blind, (I use software to write incase anyone was wondering apologies in advance fir typos its a bit hit n miss) and have other health issues which sadly prevent me from working and other activities

I live alone & have NO dependants,
I have been in reciept of
SEVERE DISABLENENT ALLOWANCE (topped up with INCOME SUPPORT)
Also.
DLA care component middle rate from 2004 wich i understand is a qualifying benefit for SDP

SDA & DLA also being a qualifying benefit for DISABILITY PREMIUM

I had a benefits check and reassesment i. 2008 in which SDP ect was claimed with help from council Q&A. No DISABILITY PREMIUM WAS ADDED I continued to get SDA + IS

Conclusion my DLA mobility rate was changed to Higher rate component

In 2009 i was advised to ring job center + (by benefits officer from council..who couldnt help again as too busy) to ask if i was entitled to SEVERE DISABLMENT PREMIUM as had not heard the previous year (te time frame was about 4 months)
To which i was abruptly told no by a guy who sounded as if he was having a very bad day ..not a pleasent experience ...this deterd me from bothering again

From (Dec 2011 TO FEB 2015) i had a carer who quit due to his mother sadly being long term ill, he could no longer care for me ...so i did not receive SDP or DP in that time period ...during this period my benefits were not affected I continued to get SDA + IS..NO PREMIUMS ATALL..EVEN THOUGH I HAVE UNDERLYING ENTITLEMENT

Since i no longer have a carer ,I was awarded SDP from febuary 2015..... But still no MENTION of the lesser DISABILITY PREMIUM

To my understanding . DP is automatically calculated and added to any other means tested benefit or you apply for SDP using for IS10 or its previous equivilent you may be entitled to, in my case SDA with INCOME SUPPORT and underlying entitlement due to DLA with MRC component

Am I owed anything in SDP or DP for the period 2004 (DLA MRC)..or 2008 (SDP APPLIED FOR) TO Dec 2011 before i had a carer ...as i never received anything for SDP before Dec 2011.

I have never received Disability Premium

Or have i simply missed out due to being missinformed or to time involved

Although was told of a case nearly the same as mine backdated to 2002!! The recipient had over £23,000 backdated!!!

Any advise greatly appreciated before i try to contact the dwp/ income support and make a fool of my self

If you were receiving an IS support top up before the SDP was applied this means you were receiving the Disability Premium as you wouldn't of been entitled to IS otherwise.

For the period when you were awarded MRC of DLA were you living alone and were DWP aware of this?

I have had a case where a person was awarded £15,000 backpay due to NO change in circumstances since awarded DLA MRC.

On the other hand i had a case where a person wasn't awarded a backdated amount due to having an ND in the property who had left 5 years previously because the onus was on the claimant to inform DWP, the SDP was applied from the time they were informed.

I would challenge the award if you were living alone at the time although if they had you living with someone else on their records i wouldn't be too confident of a favourable decision.

As for now you are entitled to an Enhanced Disability Premium due to receiving HRC of DLA.

If your SDA is currently £84.75 you should be receiving £96.15 top up of IS which includes DP, SDP, EDP.

Contact JCP and query your entitlement by informing them of the rate of care of DLA you have been awarded and give the date it was increased to HRC.

If DWP had no reason to believe you didn't live alone and If you feel you were entitled to an SDP previously and there was no reason why they didn't apply it to your entitlement it may be better to put your query in writing giving dates and request a reason why it wasn't awarded at the time.

Thank you this is usefull ...but i only receive middle rate care

Apologies, i read your DLA was increased to High Rate, didn't realise it was mobility component.

That seems correct for current amount.

According to last entitlement letter from jobcenter+ dates jan 2011 before i had a carer ....i was getting

Minus £74.45 (SDA Means tested)vja

The plot thickens .. .i just rang jobcenter+
I informed them i have been in reciept of DLA MIDDLE RATE CARE FROM 11/05/2005

They adviser proceded to tell me i hadn't been awarded SDP because from August 2005 i had a carer ...this is ccompletly bogus...i didn't actually have a carer till december 2011 to jan 2015!!!!

Couldn't believe it!!!
