Hi
I am in the middle of TUPE and have just been informed that the 5 extra days holidays we can achieve in a year are illegal because they are earned by not having days of sick so people with a disability may not be able to earn these, so these will not be transferred across.

People with a disability could earn them as one of the provisions of the Disability Discrimination Act is that sick days due to a declared disability can (must?) be discounted for disciplinaries etc so they could be discounted for earning extra holiday0
