  • I've been doing a lot of thinking this afternoon and I do have outgoings still even though I have nothing coming in, can I have a negative balance on the BR forms and just explain i've been paying it with saved money and support from my gf?

Really. I would just put down what your present situation is down on the forms, and add how you are likely to change this in the extra notes section so the OR has a heads up.

As long as your are insolvent on the day of the hearing (and for some time previously) it doesn't matter.

    I wouldn't bother delaying the appointment.

  • Well i've got my BR appointment on Thursday (9th Aug) and finally getting down to filling in the forms today, I know i've left it late but I just kept putting it off and off, i'm sure many of you know how this feels.

My question is this, i'm not working right now, not claiming benefits either as I left my job voluntarily about a month ago, just living off a little saved money and help from my girlfriend. So basically I don't have an income BUT as of 15th August I will be moving house to live with my girlfriend and will then get a new job, already looking now but obviously not likely to start work til around start of september.

On my forms should I put down what I estimate my outgoings will be and explain that once I have moved I will be in new employment? Or should I put something else, i'm really not sure on this.

I know almost exactly what my outgoings will be, therefore I know how much I need to be earning a month, this helps when I look for a job to make sure I don't earn to much and end up with an IPA if at all possible, I know this is cheeky but I really want a proper fresh start and making a payment for the next 3 years will be a slight weight on my shoulders, nothing compared to the debt i'm in now, but with the new home, new job, I want to get the cleanest break possible. I also think it would be better to put down the figures on the forms so the information is readily available for the OR rather than them having to get this off me once I get a job.

I'm sure this is only the first question of many I will be posting throughout this afternoon, cheers guys!

    Hi Experiment,

I'm no expert even though i've been declared bankrupt and recently discharged but you do seem to be making hard work of things. If you havent got a job then your income is zero, if you have outgoings then your being supported by somebody else, keep it simple and honest. And if you want to keep your girlfriend don't leave it too long before you get a job.

Cheers Fermi, that was my original intention, but i'm sure ya know how it is before you go BR, one post can make you doubt everything.

I'm going to give the insolvency service a ring in a little bit just to clarify things, last thing I need right now is to have the judge decline the petition on some detail like this, took me long enough to get this £485 together!

Thankyou, thanks and thanks again...that comment caused some much needed laughter & smiles with me and my girlfriend, we haven't had much to laugh and smile about this last few months with the BR

  • I get so angry with myself sometimes, worry myself stupid over nothing, just spoke to the IS, they said it's not a problem at all, just explain in the notes that i'll be starting work in due course. Thanks to everyone for your replies and help on this :D
