can my ex take money out of my account

Please go easy on me as I'm new to this.

I'm a single parent to my little boy and work really hard to get my money, I was seeing a guy for the last 2 years and we booked a holiday together for the 3 of us, we r ment to go in may, but today we have split up and he is now refusing to pay his part (which is £1000) holiday cost £2000 but with a free child place so each adult is costing this, I payed the full amount using my savings and the money he was to give me was to b my spending as iv nothing extra. Anyways he's said today if we kiss and make up he will pay me the money as he would b going. (But I know its not going to last till then so I know he won't end up going) I've told him I'm happy for him to go the holiday we just won't b a couple. But anyway my main concern is if he puts the money into my account this month then things do turn sour again can he go to his or my bank to get that £1000 back out of my account. (I'm worried because I know when an electric company took extra out my account I filled in a form the bank gave me the money instantly then got it back)

Hopefully someone can help me out as I'm really concerned, if he doesn't pay his part I won't b able to afford to go full stop and both me and my wee boy are counting down the days to go.

And in case anyone thinks I'm doing him out of any money I'm not, he owes me way more but the extra I can deal with as it come, I'm only really concerned about being able to take me wee one on this holiday :'(

    The form you filled out was probably an indemnity.

    He could claim it was a fraudulent payment, depending on what kind of person he is. Otherwise, unless he has access to your account, no, he shouldn't be able to get it back.

  • Do u think he would have a leg to stand on by saying its fraudulent? He would b the one walking into his bank asking them to transfer the £1000 into my account.

    I think that was the name of it :)

    And as for his personality that's unknown and the reason for the split. Iv known him to pay debt off that wasn't even his because he felt partly responsible, but although he booked this holiday he's telling me he's not giving me a penny towards it if we aren't going as a couple!!!

    I hate him for this and he's just gonna make me pretend I want this relationship till I get back k from my holiday so as we can go :s its not right xx

    He would have to do a money claim to get the money back as the transfer would have been done by his own volition - therefore not fraud and cannot be refunded by bank.
  • well to be honest with you if i had just split up then i would not want to go on holiday as a pretend couple either it would be real awkward do you not think?

    And not rich at all, I know that but I'd rather tell him OK then get him to pay his half which he is doing at the end of this month at latest. We haven't fell out as such so we can still get along so once he pays no matter what happens with us I'm not going to say he can't go. But its not right for him to agree to a holiday and then when we split up because of his wrongdoing I'm left to pay his bills so if I need to pretend to b happy till I get the money then I will :p
    Never know things might actually fall back into place n it would b real but let's just see :)
