Rentcharge question for childrens play park

I was hoping someone might be able to advise/help with this.


I bought a new house in 2011 on a new housing development that contained a childrens play park that would be paid for by the residents of that estate. One of my neighbours has moved house recently - the new owners do not have to pay for the park because collection of the money cannot be enforced (-so I'm told)


On our deeds in describes a rentcharge - I think this is the bit relating to the annual charge for the park.


'(21.12.2011) A Transfer of the land in this title dated 25 November 2011 made between (1) BDW Trading Limited and (2) xxxxx and xxxxxx contains a reservation of a rentcharge as therein mentioned.'


I have since looked into the rentcharges at www gov uk / rentcharges which if I understand correctly - new rentcharges cannot be created.


I am concerned that I am paying for something that I don't have to. I don't know where to turn to for help, other than paying a solicitor to look into this.


Any help or advice would be appreciated.
