Council moving my car
Hi all,
Strange one this, left my car in a side street I use every day with no restrictions to park and returned tonight to find a yellow line painted under my wheels and a flat tyre, the car has 100% been lifted as there are 4 clean spots on each of my alloys which tie in with the clamp things they use. I have no proof that the tyre is anything to do with the lifting and i can't prove it even if it was but do the council have the right to pick my car up without any warnings or signs indicating a road it going to be lined?

At least they did not tow it and charge 200 pounds for the privilage of getting it back. As for lifting it Im not sure, it may well have been the contractor.I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0

If it's on a public road, the authorities can remove any vehicle at any time.
If they damage it through negligence, you have a right to have it repaired at their expense.
It's as simple as that really but you might care to consider any/all of the following as may suit your circumstances:-
Regulation 103 Road Vehicles (C&U) Regulations 1986
Section 137 Highways Act 1980
Section 28 Town Police Clauses Act 18470 -
Don't usually do that round here. They just leave a gap and come and paint them in a few months later. White lines and what not as well.0

Write to the Council asking to see the published notice ascertaining to the painting of yellow lines. If they can't produce one, then they have breached the regs so the lines have no enforceability.
Whenever a Council carries out work on the highway (such as putting down lines, changing speed limits etc) they have to publish a notice outlining the work in the local press, giving not less than 28 days notice.
The Council (or their contractors) are liable for the damage caused to your vehicle (the flat tyre), so chase them all the way to Court if can.Never Knowingly Understood.

Some people do. One of the reasons I get the local paper is to see what the council are up to.If it sticks, force it.
If it breaks, well it wasn't working right anyway.0
