Code 25 - parking in a loading place during restricted hours without loading

Good Afternoon all,

I really need help and advise, I had a parking ticket for parking in a loading bay in my car, however I was collecting a parcel from a near by shop, I was 5 minutes tops. On the parking ticket it states they observed from 09.51 to 09.54. I have had someone advise me they must observe for a minimum of 20 minutes, I cant see much online to help me support my case before appealing, I really do hope someone on here can help me. Really appreciated.

The implication is that it is a council ticket ? Is that correct ? If so https://www.pepipoo.com will be a better place to get help.

They don't have to observe for 20 minutes but conversely, you CAN load for 20 minutes! Basically the CEO - if he observed for 5 minutes - would in theory be within his rights to issue a PCN - but you've said 4 mins so looks like this was unfair observation, could not discount the possibility of unloading/loading activity.

You should appeal this - show evidence of loading/unloading such as a work sheet, or a letter from an employer or customer or whoever the person was at the premises. Many Councils will cancel early if you prove loading and if not then you WILL win at adjudication if you can prove the loading. Waste of your time but you will win in the end.

Also it all depends on the nature of the parcel. If it is less than (IIRC) 15KG then that doesn't constitute loading unless you are a courier.

But the person should just say it was a large unwieldy, fragile or valuable parcel, or several things - it's not just about the weight of the item. Councils might say that, but it ain't so. For example in the 'Jane Packer' flower delivery case the Council lost and the flowers weren't heavy!

Genuine need to park nearby to load the items, is the test.

Yes it is a council PCN and also at the time I was heavily pregnant, I do not have proof of collection as did not keep receipt
