CCJ statute barred??

Hi Guys,

I received a CCJ back in Nov 2009. I had an attachment of earnings enforced and paid £200 every month. I watched the balance slowley but surely come down via my experian credit report. The last time I checked it showed that the balance was zero. That account has now been removed from my credit report as it is older than 6 years.
The CCJ is obviously still showing as it wont be 6 years until November.

Now, in the past 8 months I have started a new job. All going well, earning a good wage and no attachment of earnings, so i thought things for once were on the up. Last week I received a letter from the NI Courts services with a summons to appear for examination as there was still an outstanding balance on the CCJ of £2400.

This letter is addressed to my old address but my postman knows me so obviously delivered it to me. Should I ignore this because of this? Is there any way to fight/contest this as I really dont want £200 coming out of my wages again.

Does the CCJ drop off my credit report in November when it is 6 years old and is it enforceable after that?

Really dont know what to do here, and Its stressing me thinking of losing a chunk of my wages again.

Any help is greatly appreciated.

    I wouldn't ignore anything from the courts. If your AoE hasn't transferred to the new employer it may be that you have to keep on paying. Just because something drops off your credit report doesn't mean it's statute barred and you no longer have to pay it

    I don't understand, sorry.

    Do you truly believe you have paid the CCJ in full now or not? :huh:

    If you think, I mean prove, you have, then of course you can question why you are now being pursued for £2.4k.

    If however, you do still owe £2.4k, then you'll have to pay it.

    It maybe stressful for you, but have you considered how much stress the innocent creditor is suffering still waiting for £2.4k after 6 years???

    CCJ's don't die after 6 years ... they'll follow you for life and then possibly be taken from your estate if anything is left (unless you pay them)

    It's probably too late to dispute the original judgement now after almost 6 years, especially as you have paid at least some, if not all of it.
    If your claim is that you have paid the original judgement in full, then contact the court who are usually very helpful in explaining the process. Perhaps they will say the summons you have to attend an examination would be the place to prove you have already paid the judgement in full.
  • Yes, I do believe I have paid it off in full. Why would it show a zero balance on my Credit Report if there was still outstanding monies owed.

    Because they sent the letter to my old address does this help me in anyway?

    How much was the CCJ awarded for? I would suggest you look at how much was claimed, and how much you paid.

    If you've paid the entire claim, great, you have a case and can apply for a certificate of satisfaction.

    1:how much was owing at the beginning , 2:how much when the attachment of earnings was placed on you , how long since the AOE


    (AOE) mths x £200 = what you have paid.


    deduct this figure from 2: = how much you owe


    forget expedian etc , they get thing wrong all the time


    if you have been paying back £200 per mth since 2009 , you will have paid back something like £14400 , and they say you still owe £2400


    start doing some maths


    answer those questions


    date of attachment,,,,,,,,,,,,,,,,,,,,,,,,
    time out of work (mths) since AOE,,,,,,,,,,,,,,,,,,,,,
    amount owed when AOE was applied ,,,,,,,,,,,,,,,,,,,,,

    Did you tell the creditor you had moved? If yes, then you can us that as grounds to say that you didn't receive any attempts they may have made to contact you. If you didn't.. well no, not really.

    I would get in touch and find out exactly what if anything you still owe. If you still owe 2.4K they will find you sooner or later. on the other hand you might be worrying about nothing. The only way to find out is to get in touch.

    Your credit report is reliant on information being reported to them by a third party and is therefore not the proper reference point for checking the outstanding balance. You need a statement from either the court of the company that you are paying the debt to. This will offer you proper clarity.
