Gym has reinstated my membership without my consent

Can a gym continue my contract after the agreed fixed term of 6 months has ended? i signed up for a 6 month contact in May last year with the contact ending in October. I just realised yesterday that the gym has been taking money out every month since that's £59 per month for the last 5 months!! if i wanted a longer membership i was given the option too at the time of signing the contract but i made it clear i only wanted 6 months as it was quit expensive and i couldn't really afford the first 6 months but as i'd been given some money decided i would sign up. Yet after a phone call to the gym this morning the lady i spoke too seemed to think (based on their system) that i was still a member and i still had one month of my contract left until she looked back and realised my contract had been automatically restarted after my initial 6 months. So much for money saving.....money throwing away more like....i'm so annoyed!!!! how dare they reinstate my contract for another 6 months without my signature or asking or even making this abundantly clear at the time of signing the contract.

Any help or advise where to go would be great as i wish to pursue this matter and hopefully get my money back.

What did your original contract say about cancellation or roll-over?

Most gym contracts are not fixed terms - they are a minimum term after which you can cancel. If you don't cancel it rolls on.

Not sure as it was over 5 months ago when i assumed my contract had ended. The term was for either 6 or 12 months not a rolling contact. I signed up for 6 months and after speaking to the lady at the gym in her own words she said " you still have 1 month left of your 6 month contract" however this is the second 6 month contract which i dint agree too?

As for gym terms and conditions I'm not entirely sure but I'm guessing just coz something is written in there t's & C's doesn't make it legal?

They haven't contacted me once since October to say that the contact was being reinstated or rolling on. In my first 6 months (which i signed up for) i would get phone calls and emails from the gym instructors asking why i hadn't been for a few day and try to get me to book onto classes, yet since November despite them reinstating my contract no one has phoned or emailed to ask why i haven't been in....not once in five months yet i couldn't go a week before without an instructor contacting me.

A lot of companies work like this including all the mobile companies, Sky, Virgin media e.t.c.

You need to actually cancel the contract normally 1 month proir to leaving or they will continue to charge you for the service. did you ask them to cancel the contract?

I didn't ask them to cancel the contract as i assumed our agreement would be over after the 6 month contact period as this is what i signed up for (it was a 6 month contract), i didnt sign up for a rolling contract or 12 month i signed up for 6 months and i even told the fella that i could only afford the 6 months yet he failed to mention anything regarding their cancellation terms or how they would just reinstate my membeship. At no point did anyone mention the contract rolling on and more annoyingly they haven't contacted me to ask why i haven't been in 5 months though paying every month when like i said before they would pester me to book classes after only a few days of being away???

"We offer 3, 6 and 12 month memberships to 350 members only with a waiting list option after that"


it doesn't say we offer continuous membership or rolling membership it states the actual memberships lengths available to sign up for?

So do i have anything going in my favour or am i basically stuffed?

How come you didn't notice that they have taken £59 each month for 5 months, if you were so tight for money, even in the first 6 months?

That's where you went wrong.

You would need to refer back to your original contract for the actual T&Cs, but it's legal for them to say that it will continue as a rolling contract or otherwise if you don't let them know you want to cancel.

The six months is the minimum term you are contracted to not the only term. Gyms work the same way as everybody else, if you don't cancel it runs month to month until you do. This is standard practice, nothing hidden or deceitful.


The thing I can't understand however is if you can't afford this every month how come it took 5 months to discover?

Did you read the contract prior to signing it or did you do the whole idiotic thing of signing it without doing so? No doubt that contract had a section on cancellation, I'm willing to bet that it would contain something along the lines of "if you want to cancel you need to provide us with 1 month's notice".

Besides, it took you FIVE MONTHS to realise they were taking £59 a month out of your account, man I'm relaxed about what's coming out of my account, but not THAT relaxed.
