I have posted here before about the position i am in ...I was gaurentor to a loan Amigo loan I lost my Job and was out of work for 3 years and dropped in it ..I am in no position to pay as I also have other debts and plus going through a divorce which and my ex has left me in all sorts of debt ....I took advise from here and went through a debt management company 'Stepchange' everything was fine until today when I get a E mail out of the blue from Amigo saying they are going to take me to court over the debt as it will take to long to pay ....I have nothing left ...what should i do ..I thought by going through a debt management this would help me ....I am now at my wits end ..i have no more to give ...
PS I have been paying them for 4 years £108 per month before I got into troubles we still owe £2100 .

PS I am looking for positive answers not negative comments ....

  • As long as you have been repaying the debt as stated then just protest either through the debt management company or directly to Amigo in writing retaining your composure without letting rip. Point out to Amigo that their actions are unreasonable and pointless as this will cause further delays and unnecessary bills. See what their response is and then take it from there. Yes it's easier said than done but try not to waste time worrying about what might happen.

    They go to court, you rock up with all the details of your dmp showing that you are dealing with your debt responsibly (and not trying to avoid payment) they are going to look a bit foolish. I would imagine any judgement would be sympathetic to you.

    Further to that, they can't have what you haven't got. The biggest threat for taking people to court is the ruination of their credit history, well yours is already shot, so what have they got?

    Try not to stress, the DMP support thread will probably have good advice to you

    Thanks All ..I have sent them a polite e mail asking WHY ..all they seem concerned about is the fact the DMP is paying them £17.50 which will take 10 years to pay off the debt this was set up last December ..until now i had heard nothing from them and assumed everything was OK, then this ...I have taken Martins advise and saved some money by trimming my utility bills and changing suppliers etc and with the money saved on using less since the wife left £25 a month lol ..perhaps I should offer them that ...:D

    Don't offer it to them. If you have to draw up a new budget you should split any extra funds between all your creditors according to how much you owe. But I wouldn't bother doing that unless it looks like they are taking you to court.

    I have 4 creditors all in my name ....so yes I am liable ...my hopefully soon to be Ex wife was not very good with money ....she run up payday loans and c/c loans and catalogues unknown to me ....as she was on the mortgage i had threats against the house charge orders etc , ( which i now know where empty threats ) when i found out i had to take out a loan to pay them off ...but soon afterwards lost my job she p''d off leaving me to foot the bill ...if i rock the boat she will go for 50% of the house ...so far i got the better part of the deal ..i pay the debts ..she leaves the house with me .... women !!!!:mad::mad::mad:

    Make sure you get that written down in 10 foot high letters of fire and signed in blood!

    If I were you I would pass everything on, unanswered, to the debt management company. That is what they are there for. I had a debt management plan once and the odd creditor would try it on occasionally by saying they wanted more. Let the DMC sort it. I had one creditor who decided, without telling me to write off the debt and marked it as settled. The result was Link writing me a nasty letter saying I had settled a bigger debt than them and why hadn't I settled them. It was the first I had heard about it! I gave it to the DMC to sort.
