Being robbed of inheritance

Lost my dad to cancer in 2010 - he didn't leave a will so my two older sisters became administrators of his estate - his house valued at £140000, my two sisters are now refusing to sell the house thus leaving my self and my neice ( a beneficiary after the death of my brother) without anything from the estate - is there any action I can take to free up my and my neices share of the estate ?

What is happening to the house?

as I understand it, as he died intestate. the estate is split in equal shares amongst surviving siblings of blood relation.

check out thelawforum.co.uk or legal beagles. they seem really good at explaining what to do, and means your not having to spend loony amounts playing letter ping pong with solicitors.

You need to get a solicitor involved. Why have you left it so long? You can, as a final resort, force the sale of the house and distribution of the estate. The executors are fully liable for all the costs of their inaction.

The can do nothing till the day they die unless someone takes action

The courts don't care once they agree an application to administer an estate.

Find a solicitor who deals with contentious and non contentious probate and speak to them. On the face of it, it sounds as though your sisters are in breach of their duties as administrators.

As a first step, a formal solicitor's letter reminding them of that and that they will be personally liable you have it take further action, may get things moving. Are they living in the house, or is there a different reason why they have not sold it yet?
