Natwest Advantage Gold Claim rejected

I rang Natwest complaints last Friday regarding misselling on this account. We had the account since 2002. Originally sold as only privileged customers could get it. I was aware of the free travel insurance and mobile phone insurance most. During that time my daughter lost her phone, tried to claim but was told I needed to pre register the phone, which I wasn't aware of previously. Also, the first time I decided to rely on the travel insurance, I rang them to check my husband would be covered as he had a number of pre existing conditions. Of course he wasn't without paying something like an additional £300+ premium. We bought the insurance elsewhere.

I was nervous of cancelling the account because during this time no had constantly increased our overdraft and because things were tight and I wasn't as financially sensible as I hope I am now, I thought they would pull the overdraft and I had no way of paying it off in one go. In fact (I forgot to mention this to him) I did apply for it to be turned into a loan at one point, and they turned this down as well. I have now been fortunate enough to pay off the overdraft, and Downgraded the account on the same day.

They rang back today to say they weren't upholding the claim because even tho I would have to pay extra for the travel insurance, an element of it was still available to us. Re the phone insurance, they weren't as strictly regulated in 2002 so they weren't guilty of misselling.

He is putting it all in writing for me, and off to the Ombudsman I go!

Does anyone have any thoughts of whether I am in the right?

    It's always worth appealing to the nth degree.

    Please be polite to OPs and remember this is a site for Claimants and Appellants to seek redress against their bank, ex-boss or retailer. If they wanted morality or the view of the IoD or Bank they'd ask them.

    You just need to follow the proper procedure, complain to the bank with your evidence and proof (don't send originals) e.g. proof you had no phone or phone cover elsewhere, proof of your travel insurance and see what the bank says. If they reject and you disagree you should be advised if you can refer to the FOS (an adjudicator) and if they reject it, ultimately the ombudsman.

    Unless you provide the details of your case and details of the rejection if you got that far it's impossible to advise
