Bought brand new bike from ebay, broke after two minutes of riding – advice please?

    It's no different than buying a bike as an Xmas present for someone and giving them the receipt with it in case there are problems.

    Only the person who bought the item has a contract with the retailer. If a relative gives you a receipt with your Christmas present then you have no rights with the retailer at all, although of course some shops may well not bother asking if you were the purchaser. However, any refund on a card purchase would go back to the original card ...so not ideal.

    Although a lot of stores now offer "gift receipts" specifically so the recipient can return the item themselves, especially in the run up to Christmas. These receipts don't show the price so you can give the receipt with the gift in case they want to return it.

    Had a quick look at M&S and their website says:
    Please note, if your recipient wants to return their gift to store, then they will receive a credit note. If your recipient returns the gift via post, then the refund will go back onto the card of the purchaser.

    This however is not a return it is a claim that bike was not fit for purpose when bought, neither is it a gift receipt.

    The post I quoted suggested that the contract could be passed to anyone if item was a gift and receipt was passed over with the gift.

    Anyway, OP,posted this in 3 different forums, has had a number of responses and has been online posting since and appears not to want to respond to any answers at all.
