section s144 police refusing to act

long story can be seen in the wills probate section, but basically:
Dad died 2012, no will with any solicitor, no probate been done.
neighbours say step brother, no blood relation, living in Dads house since he died.
SB's Mum, Dads new wife, died 2009.
SB sold his car, emptied bank account, cashed life insurance, SB decided to separate from his wife at the same time. SB sold his own house.
sent him a letter this year asking whats happened, no reply. sent second letter signed for. refused to sign it saying that he thought it was his ex after something.
I have Letters of Admin, and have notified Land Registry im the new owner.
now ive been informed I can get him out using s144? but so far the Police have refused to act. he also drives an uninsured untaxed unmot car also, which they also have failed to act on.
every time ive phoned them about my Dads car being effectively stolen or s144. they say its a civil matter. ive put a complaint into IPCC awaiting response.
ideas?

You also need to find out if Dad's new wife had a will and how the property was held.
If the property was in DNW's name, then Dad may have been living in it without any legal ownership. Whatever you do, don't accept any rent from him as that could be construed as creating a tenancy.
IMHO given you don't know him at all, you either play nice and notify him that you want Dad's house back or your do a swift eviction. You don't know if he is dodgy. He could reasonably have thought he had some claim on the house, given his mother used to live there. Let's face it, if the mother was alive he would have stood a good chance of inheriting it. going by what ive learnt about him so far from neighbours, plus what my Dad said to a friend, describing him as a waster. I think we can safely assume his character is not the best. plus my Dad had my number and the SB knew I existed. yet he contacted my Dads friends in OZ when my Dad died, but didn't contact me. nice.
makes you wonder if he had planned it all along.0 -
