Agreed.
But how often have you heard "it's in the post !".
The order cancellation had been accepted - therefore anything that arrived WAS unsolicited.
Both common sense and legally.0 -
im pretty sure the OP knew it was in the post and it was perhaps assumed lost, so when it arrived it was a case of it just arriving late regardless of it being canceled. What do u expect this company to do stand at his door waiting for the parcel to perhaps arrive so that he didnt have to receive it?
I agree that they where kind enough to refund on it when it was thought lost, so you should be kind enough to let them know its there so they can pick it up0 -

Perhaps someone qualified to comment on the law can come along here and confirm what is being said.
This is not a case of how often we have heard it's in the post.
The paperwork with the parcel would clarify this . . . as I said all along if the item received was that originally despatched / ordered then the item received is most definitely not unsolicited legally.
I don't think the op should incur any costs to return item but it is not his to keep.Baby Milk Action is a non-profit organisation which aims to save lives and to end the avoidable suffering caused by inappropriate infant feeding.0 -
Forget the nitpicking nonsense of it being unsolicited whilst cancelled in transit etc. Its just hair splitting nit picking jibberish
Use your common sense.
Does it exists on these boards any more?0 -

So true!
Whatever the law says (and before anybody asks, I don't know exactly what it says on the subject), the courts will not apply statute or precedent that will allow an absurdity.
This thread actually didn't need to go past the first response, where Deanos summed it up perfectly:Just ring the company up and say they have 7 days to collect it, you do not have to pay return postage its there mistake.Gone ... or have I?0
