problem with used fragrance purchase

Hello,

I bought an opened Men's Fragrance on ebay, described as "New Other" and "only used a few sprays, only a couple of months old".

I've received it an I think that it smells old or stale. I was going to email the seller even though it is a "returns not accepted", but if they are not helpful, can I expect any favourable help from ebay on this given the circumstances? Anyone have any experience of this please?

    Contact them via ebay messages using the header 'I have a question about using my item or I want to send the seller a message'.

    The item should not have been listed as 'new other'. If it wasn't described as being stale and you get no joy with the seller open a SNAD and NOT a returns request. You do this by opening a case under the header 'I received an item that wasn't as described' rather than 'I want to return my item'.

    New/other for Health and Beauty means - New other (See details)
    A new, unused item with absolutely no signs of wear. The item may be missing its original packaging, or the original packaging has been opened or is no longer sealed. The item may be a factory second, or a new and unused item with minor defects. See the seller’s listing for full details and description of any imperfections.

    I am pretty sure you are not allowed to sell used or open cosmetics and that includes perfume. That may be why they listed it as "new"

    Well, it's ambiguous but I would say they are restricted at best, not excluded.

    Policy overview

    Perfume testers and dramming bottles (which are bottles from which small quantities can be taken for supply to consumers as free samples), typically marked with the words 'demonstration' or 'not for sale', may not be listed on eBay. Also, you need to make sure that the essential and legally required information - such as, among others, the identity of the manufacturer or the person responsible for marketing the product, the composition of the product (content and list of ingredients), the use of the product (function and particular precautions to be observed in use) and preservation of the product (date of minimum durability) - is not missing from any permissible cosmetic or perfume product. Smell-alike perfumes may not be listed on eBay when they are compared to a well-known brand or scent. You may not list a perfume in a bottle other than the original bottle (decanters).

    Allowed
    New, in-box full-sized cosmetics
    Factice bottles (dummy merchandise bottles)
    Collector items (empty bottles)

    Restricted
    Perfumes in their original bottles including miniatures and samples can be listed as long as you make sure that the essential and legally required information (see Policy overview) is not missing and that the box is not missing if the bottle came in a special box
    Homemade cosmetics can be listed, as long as you make sure they comply with country regulations
    Smell-alike perfumes can be listed, as long as there is no reference to a brand in the item title, attributes or description and the item is not listed in a category for branded items. Also, you are not allowed to circumvent this rule by misspelling brand names or otherwise trying to refer or allude to a brand.
    Unboxed cosmetics or perfumes from certain top brands may be subject to limits or restrictions.

    Not allowed
    Items that are not allowed include, but are not limited to:
    Testers
    Dramming bottles
    Decanters
    Listings for products that do not comply with the requirements of the Cosmetics Directive (see Policy overview)
    Used cosmetics
    Replica perfumes or cosmetics

    I sent a perfume to Switzerland at Christmas and got a letter from Royal Mail saying that it had been destroyed as I was not allowed to post perfumes.

    How did the Royal Mail know what was inside? Did you have to declare the contents?

    Stuff is routinely x rayed now and there were a surprisingly high number of sellers reporting getting caught out when the rules changed about perfumes.

    Yes I probably filled out a CN22 as it was switzerland - donut - should have remembered it was prohibited!

    Its a nightmare trying to send perfume outside the UK. Everything is X Ray for sure.

    People do sell used perfume on eBay, I know I buy and never had a problem. Only if a small amount has been used. Perfume lovers its all about the vintage:D

    OP, give the bottle a few sprays and see how it is after that. What can happen is if the bottle has been sitting for a while unsprayed, some of the last spray can sit in the pump bit. So you need to give it a few sprays for the fresh juice to come up.

    Or it could have been stored improperly and gone off.

    x-rayed , probably also contained alcohol.
