Gifts out of Income

Hi folks, I was just filling in the IHT403 form for gifts when I noticed the 'gifts out of income' box. I had always thought a maximum of £3,000 could be gifted in a single year but it seems that any amount can be, and be exempt from IHT if the gifts are made as part of normal expenditure out of income rather than out of capital? I assume capital here means out of savings? The gifts I received were out of my brothers savings so I assume I am stuck with the £3,000 allowance?

Gifts from income would show as regular outgoings fron his accounts, for example if he had income of £2500 a month but had a lifestyle requiring only £2000 a month then he could give you £500 a month every month which would be tax free.
If he was doing this but maintaining his lifestyle with regular top ups from his savings then it could really not be classed as surplus income so up to 7 years of those regular payments would still be subject to IHT.0 -
You would have to use the £3000 allowance, but you can bring one year forward as well so a total of £6k provided there are no other gifts that need to be covered by the annual allowance.
The gifts out of income require a lot of proof that your income is well in excess of your monthly needs and to be shown as regular outgoings.:heartpuls Daughter born January 2012 :heartpuls Son born February 2014 :heartpuls
