Thank you for your advice. The ball joint was repaired at the garage where we bought the car, they charged us.
Then you should ask for a refund. It is the seller's responsibility to ensure the car is checked before sale and i would of thought the ball joint would be showing signs of near-potential failure when it was sold. Faults which existed at the point of sale are the responsibility of the seller otherwise he shouldn't sell it.

So average joe public should know this? No, they don't.. I came here asking for advice, not a public attack on myself by a stranger!
should I apologise for wanting to know if I have any rights as the car that I bought is making me dizzy, nauseous and gives me headaches from the exaust fumes? The same car that my 3 young children sit it. Carbon monoxide is a killer, have you not seen the adverts?

If you have no budget than go buy some tools,workshop manual for the car and go fix the things there that is at fault ,at least you will learn a new skill! youtube is full of tutorial ...
If not go get a garage to fix the car and spend probably more than it's worth,
But don't mess with people just because someone sold you a 14years old car for probably 5% of it's starting price ,did they forced you to buy it and you couldn't check the car before buying it? Next time before buying a car just take it to a local garage and ask them to do a check-over on it and they will give you an idea!
And YES you could Legaly take them to the cleaners for selling you a banger with some faults since they are trade sellers but lets be realistic here you bought a crap car to start with , with no MOT for 700quid and you expected it to be showroom quality0 -

Firstly, I did buy it from a local garage
Secondly, who said anything about show room quality? Not being poisoned would be a great start, not stalling on a motorway whilst in the fast lane would also go down well.. 2 major safety concerns. I do not care if the car is a year old or 20, safety is a must!!
Thirdly, who said anything about me not having the budget?
This was a quick buy due to some oik driving in the the back of our old car, I have no experience in what a car should/should not sound like, for a start I don't drive, I don't even know where the oil goes!! I don't have a mechanic on speed dial to accompany me to look at cars.
So please, do not think everyone should know if a car is road worthy just by looking at it. I trusted the garage where I bought that car from to inspect the car to make sure it is road worthy and legal.0 -

About a subject I have no knowledge in, I should have common sense to tell if a car is ok by looking at it. Words fail me!!

Exhaust fumes inside the car is likely to mean an issue with the exhaust manifold or the flexible section before the main part of the exhaust. This is because the air into the cabin, comes in via a filter under the windscreen scuttle, it's actually very hard for exhaust fumes to get in.
It might even simply be that the pollen filter has never been changed....... Simple 2 min job, with a £6 filter panel.

The car came with 2 months mot.
I wasn't shown the previous mot certificate until the sale was finalised and the list of advisories is quite long. We were told that most of them had been rectified but I have no way of knowing if that is true.
Stalling whilst driving is a common/minor issue?
Take it for an MOT, it's almost due anyway. I doubt it will pass, if the dealer thought it would then they would've put a fresh one on and bumped the price up.
Even if you know nothing at all about cars, being asked to sign a sold as seen form should've rang alarm bells. It's no excuse.0 -
Only in UK you can buy a 14year old banger for 700quid and than Chase the seller asking to fix all that , and to top it all off It's Legal! :rotfl:

I think you miss the point of the law.
It isn't reasonable to expect a private seller without trade knownlege or training as a mechanic to be able to accurately access the condition of a vehicle. Therefore buyer beware.
A trade seller should have the ability to accurately access tha cars condition. So the law isn't unreasonable, all it requires is for the seller to declare any faults.
It isn't unfair on a trade seller, they just have to be honest when describing the condition of the car. Which of course will lead to a lower price.0 -

Ball joints are wear and tear items and can fail at anytime with or without warning. You'd be lucky to get that done on a 3 year old car under warranty let along a 14 year old second hand one. If the OPs paid the bill and not written "paid under protest" on it then any refund would be purely good will which seems very unlikely.0
