negotiating default removal.

Hi guys.

A few of you may of seen some of my earlier posts and helped me along the way and i was just wondering for those out there in the know has anyone had success negotiating to have a default removed?

Im due to get paid this friday and call and pay off my last few debts and was wondering before i do that is it worth calling or writing and basically asking if i pay the debt in full will they remove the default from my credit file? Obviously i would get this in writing but has anyone had any success doing this type of thing iv searched the forum but couldnt find anything concrete.

    I didn't unfortunately, even though I was told over the phone that I would have this removed. I got the credit agencies involved (they quite rightly explained that the default was reflective of my credit history). I complained to the ombudsman and (a whole host of work later) they requested copies of the phone conversation etc... they told the company who the default was held with to compensate me £100 for distress caused. However the default remained. Good luck!

    You can ask, but do so in writing and request a written response.

    Not much chance though, maybe more with a desperate DCA.

    The ICO guidance says that information recorded on credit files needs to be accurate, so I don’t think a creditor would be complying if they did remove a correct default from your credit file, although I’m sure you wouldn’t complain.

    If the creditor promised that they would remove a default before you made the payment and then went against their word you may be able to successfully complain like Agentmomo.

    They can remove an accurate default if they decide. Creditors are under no obligation to report to any CRA so can decide at any point to remove information and cease reporting even if it was accurate.

    In other words that any data that is reported must be accurate doesnt mean all accurate data must be reported or must continue.

    I have been emailing O2 about a default in 2010.

    The debt shows up on my credit file as being from Lowell the debt recovery people. Lowell told me who the debt was with as the debt shows nowhere else on my credit report.

    They suggested that I call O2 and ask specifically for the dept that deals with removing defaults. Lowell said that if i di not that I'd likely be bounced back to them.

    TRUE!
    Default answer from O2 is that they do not remove defaults EVER.
    ...well if they don't add them, then they can't BUT...


    ...they can give permission for Lowell to make the removal. I was advised of the email for the department and sent the email yesterday.

    Its something people keep repeating over and over here.

    somehow willing that to be true as it offends their sensibilities that its not.

    Tough. Doesnt matter how many times they repeat it, its still complete tosh. :)

    Lenders can of course remove the data - it is just that they won't do it

    The argument is that sharing credit data is a process there to ensure that future lenders can make informed decisions, and that people do not borrow what they cannot manage.
  • Just this week, i have x 2 defaults removed by Lowell.

    1 due to the fact it was incorrect and the credit card company told them to remove it.

    The other was removed because Lowell had made a mess of removing the credit card default and i complained. During this complaint i asked whether the other account they held of mine could also be removed. Low and behold it was.

    I asked for email proof, i received it, checked reports, all gone.

    I cannot complain with how Lowell handled my complaint.
