Typical that I should pick up on the complex point!:rotfl:

I thought as much - yes, supermarket car park is actually public road under Road Traffic Act.

So :idea:it would quite likely be due care and attention rather than failing to comply with "bit of paint across the road that purports to be a zebra crossing".

Doubtless, under 'due care and attention' a reasonable competent driver, or whatever (I don't have the exact legal terminology to mind), would not fail to comply with a crossing. However, as, in law, the crossing is not a crossing and does not even exist then I can pretend and treat it as if there isn't even anything painted there? Why should I comply with a crossing that's not even a legal crossing?:p (And there are enough rules to comply with anyway;):rotfl:.) Albeit that I wouldn't ever run anyone down and, when I'm on supermarket car parks driving, I always treat the crossings the same way as if they were zebra crossings. Interesting - where did you get the "barrister's" answer from?

    I made it up :rotfl:

    http://www.justanswer.com/uk-law/2tqso-zebra-crossings-supermarket-carpark-no-lights.html

I suppose parking in disabled bays in supermarket cp's is also not breaking any law. but I never do it and it annoys me when able bodied peeps do. (without badge in car)

What gets me (or has had me wondering on a very small number of occasions) is those "zebra" crossings in supermarket car parks for example. How are they legal, in the sense of how is there a legal duty to stop at one when someone's crossing? (Not that we would deliberately run anyone over even if there isn't any legal authority.)

Albeit that they are in a "public place", i.e. a supermarket car park open to the public, they're still not on the road highways are they? Where's the flashing lamps at each side of the 'road' and the zig-zag lines? How do they qualify under the Zebra Pedestrian Pelican Crossings etc. Regulations, or whatever, and what would (or could) happen if someone did not stop at them? If they were taken to court for failing to stop at the crossing, would they just assume that it was a legal zebra crossing and apply the same rules to them or would or could the point be taken that they are not lawful, i.e. do not have the flashing lamps and zig-zag lead ups and lead outs, and therefore they are not zebra crossings under the law but merely some paint painted across some of the car park that has no legal standing. I've wondered (occasionally!;)). Have I a point or am I up the wrong tree and these really are zebra crossings just like any others (I'm in the legal mindset in my view as to what a "zebra crossing" is)?

Maybe your crossings in car parks have full working flashing lamps and proper compliant road markings fully adherent to the Zebra regulations, but I've never seen any to my knowledge!

Oh don't Savvy :( this is a zebra crossing on a public road and sadly the majority of people using it are at best annoyed that they have to stop to let a large number of schoolchildren use it to get home :(

Most start moving off whilst the kids heels are barely past their wheels :(. I think there should be traffic lights there since our council have decided that lollipop ladies/gents aren't needed for secondary school kids anymore. It's a stupidly busy road and the kids are literally taking their lives in their hands when they cross. The behaviour of some motorists is disgusting! They drive along a road at a time they know 800 kids are trying to get home and treat the kids like they are an inconvenience

The whole world is in a rush to get nowhere fast these days. I was driving hoMe today and saw a young lady overtaking me on a bend that would have ended her life if a car was coming the other way. Where did she get? Nowhere.....she was still queued up at the same traffic lights as me when we had to stop.

People should slow down and be more considerate. Rant over :o

Another complex one - and this is a nice novel one, that I don't think anyone has ever thought of before (typical my Aspie creativeness:rotfl:) and could save a lot of money if it were able to stand up (and I can't guarantee!):

About those privately-owned car parks that purport to charge people (that they call a fine or a penalty charge) when they park on the car park without buying a ticket, on the basis of contractual relationship that they claim is formed.

What if I decide to park for nowt and instead put up a notice in my windscreen: "Notwithstanding any notice to the contrary, I do not agree and shall not be taken under any circumstances to have agreed to any charge for parking this car, my action in parking the car shall not be taken to accept anything either impliedly by conduct or expressly or in any other way whatsoever and I hereby express disclaim any possibility of any agreement and that there is no meeting of minds in any way whatsoever and I do not accept or agree to any contract of any kind or any collateral contract of any kind."

Now, I don't think they can clamp people these days (under Protection of Freedoms Act) - I may be inaccurate - and the basis they use is contract, yet I have disclaimed, or at any rate purported to disclaim, any possibility of meeting of minds - an essential element for a contract to exist - in any way. What can they do? I'm parked on their land, albeit trespassing, yet they are not allowed to clamp or tow and they can't say there is any contract as my notice expressly rules one out (and moreover trumps their own notices by purporting at the outset to exclude them all ("battle of the forms")). They might sue trespass, but I'm parked on their land for the few hours or whatever, and after that, I'm gone and even if trespass was upheld may be entitled only to nominal amount of damages for my brief stay. Moreover, if there were any other empty spaces whatsoever on the car park (as marked out by their unlawful lines:laugh: - or at least no legal authority to designate anything, the same way as a 'zebra crossing' isn't), then they could not have suffered any loss at all as any fool (paying parker) could still park in one of the empty spaces to pay and the owner would have lost nothing.

:silenced:ssh, and don't quote this post, as I'm sure if people more generally were to start doing what I am suggesting and if it were legally sustainable they would change the law and make us all paying to park.

There must surely be some flaw in what my proposal is? I think, if I was evading the car park charges, it may be better just to park and hope I don't get caught (in the few minutes I'm in the store or whatever) rather than stick a notice on the windscreen of my car drawing attention to itself:question::think:.

Response to my notice may be: "well, okay, if you don't accept the terms, then you can't park here!" But what are they to do, as I'm already parked there and they can't impose a charge or "fine" (I think that word is incorrect and ought to be reserved to criminal things) as the basis on which they do so, a contract, has been expressed ruled out and stopped by my express failure to agree to one?

Exactly 3Dogs in RL I am known as being very blunt I say it how I see it I don't see the point of maybe - it either can or it can't lol I have to say I admire your adoption of a Romanian stray it's heartbreaking what they do to them especially rounding them up and selling the to German(and other countries)gangs destined for dog brothels I'm heavily involved in the campaign to stop this happening in Europe xxx

Oh dear god I just googled that. What kind of world do we live in :(:(:(:(

I've got two Rommie oldie dogs now auto.armadillo :D:D:D We see Rommies rescued in Romania too, having been raped time after time :( And I agree, it does happen in many places you would not think of. Denmark has only just passed a law to outlaw animal brothels :eek: Most of us would say, why would they need to do that, surely it is against the law already. But no, sadly for the many dogs involved

One word of warning though is that certain Romanians who do not want to see the end of the cash cow that is the catching and killing of dogs, spread many rumours about dog trafficking and animals being shipped to other parts of Europe for brothels and animal experiments, to discredit the real rescuers over there. Many very dedicated people who give their lives for the dogs of Romania are being discreditted in this way, so they can protect their corrupt and vile and barbaric way of life

Having said that, I am totally with you on the war to stop animal brothels, etc and sign many petitions on this subject. We must talk about this more in pm, as I am very active on FB in Romanian/UK rescue, and have protested in London many times, as well as in Brussels before Christmas. And I am planning a trip to Bucharest Romania in June to see first hand what is going on :(
