'Insurance' with EE/Orange: Please help if possible?

Hi.

I have and issue with EE/Orange.

Firstly, I recently remembered that around 2007/08 I was charged 'Orange Care' on my statements and never really knew what it was. I checked this out and found that it was some form of insurance that I had never asked for.
I took a look in my attic and found that I only have two statements - one from September 2007 and one from January 2008. I think I was paying it for many months before and after this.

I have contacted EE to ask for statements but they have been extremely unhelpful, stating that they can supply recent statements for £3 a time for the last 24 months but for statements prior to 24 months ago 'request a statement of account which will show what your bill amount has been and the amount you have paid to coincide with payment dates'.

Please can I ask is there anything I can do? I seem to remember years ago when people were reclaiming their bank charges that if they only had a few statements, they could estimate the other charges?

    Orange care was an optional product that could have been removed at any time. It was to protect your device. You would have asked for it either via the web, phone or store.

    You've had the protection so why do you want a refund?

    Let me clear about this: I did not ask for it.
    Are you honestly insinuating that in these last few years, different organisations (Financial, etc), did not do anything that even resembled adding 'benefits' to peoples bank accounts, loans, etc? Do you post the same stuff to people claiming mis-sold PPI?

    This wasn't missold.

    I had Orangecare way back in 2007, They asked if you wanted it and described what it did and then they turned round and gave you the key points of the policy THEN sent you full wording in the post.

    YOU selected it and YOU could have cancelled it. YOU didn't why should Orange/EE pay

    How was it missold? Oh it wasn't

    Benefits were and are still added but its a myth that they were/are routinely added without permission, its true that many complainants use this as a complaint reason (usually along with all the other sometimes contradictory ones copied from a template letter). Its rare for a compliant to be upheld on this basis particularly when the added product is listed on every statement received.

    What evidence do you have to support your allegation?

    With no evidence, someone complaining within a short period after paying it would be credible even if the evidence was against them. However, complaining about 8 years after you first started paying for it means your credibility is much reduced.

    You can complain. You may get lucky but you have pretty much the weakest complaint going.

    I already had insurance to cover the phone and have the proof, Simonsays.

    I will be intrigued to read your reply to this then....tut tut.

    comparable insurance?
    Orange care provided a replacement handset next day.

    Satisfactory insurance, maybe not comparable. Besides, I was never one of those who NEEDED a replacement phone the very next day.

    So you say.
    However from Orange/EE view. This isnt a penalty charge.
    Its a charge for a service that is listed on every bill.
    You also got/get separate insurance paperwork.
