Unaurthorized use of bus and taxi dropoff/pick up - Minster Baywatch!!!

    I now have received the evidence that Minster Baywatch are submitting to a Popla. They claim that this road is classed as a car park. I am unable to copy and paste the whole lot as some of it is photos.

    You will need to go through their Evidence Pack and rebut everything that is either fundamentally incorrect or with which you disagree.

    Keep your eye on the date POPLA has said it will adjudicate by in order to get your rebuttal in before that date.

    Here's an excellent example of how one poster dealt effectively and comprehensively with a PPC's Evidence Pack. I'm sure this will give you plenty of ideas on how to handle your case.

    They claim that this road is classed as a car park.

    Deos the college agree that the road is in fact a car park, where for a fee you could park your car, lets say at 90 degrees across the width of the ( apparently ) long but narrow car park?

    They say that because busses and taxis park to drop off students it is classified as a car park. They say there is no evidence that the driver didn't stop also, yet they have no idea how long the driver was on the road as there is only 1 camera on exit.
    There is no option to pay a fee.

    They can class it as whatever they bloody well like, the car still didn't stop so it's still not a parking case!

    Their statement that they have no evidence that the driver didn't stop is gold dust, because the corollary to this is that they have no evidence that the driver did stop. Well it's their claim, it's up to them to prove it, but all they've got is speculation!

    You should send this to the DVLA as evidence that they have requested keeper details for the ostensible purpose of recovering an unpaid parking charge, and yet they haven't a shred of evidence that any parking took place.

    Be prepared for a long fight with the DVLA's fob-off experts before escalating to the ICO and your MP.

    I did contact DVLA and complained they obtained my details for a non parking issue. Guess what, not interested

    Like I said, you need to push it. DVLA are masters of the fob-off, you need to escalate through their complaints procedure and then go to the ICO and your MP.
