I have recently received a hefty fine in the form of an 'Order for Recovery for unpaid penalty charge notice'
It's £97 and was issued 5 months ago to my previous address. The original fine was £30, but has increased because I didn't receive it. I had promptly after moving house, changed all my details with the relevant organisations. My car is a Motability car, I updated Motability, The DVLA, and the DWP.

I contacted Motability about the fine I had received, and was assured my details and address were correct and up to date. I know how the process of Penalty Charge Noticies are issued and I know that because I lease and don't own my car, Motability are the Registered Owner of my car and I am recorded as the registered keeper. I asked the advisor from Motability to check the V5 to establish whether my details were correct and up to date. Lo and behold, Motability haven't updated the V5 and my previous address is on it.

I'm really really worried, upset, and angry. I've spent days trying to work out how my old address has appeared. I have contacted the DVLA, written two long letters to Motability (only to be told by them that my details WERE up to date, it was only when I asked them to check the v5 that we established the discrepancy). I've also been in touch with the DWP, as well as my local council, and the courts that the Order of Recovery has come from simply trying to work out WHY I had a fine sent to my old address.

I've complained to Motability about the fine and the charges which have now been slapped on top because it wasn't paid. I'm yet to receive a reply, but Its now dawned on me that they've mishandled my personal data. There has been what I believe to be a significant breach in confidentiality.

The data protection act states;

"Personal data shall be accurate and, where necessary, kept up to date."

I'm worried about the credit consequences this will have on my name, and I'm really cross at the stress and time I've wasted trying to establish then rectify their mistake. So far, on the phone, the advisors have been less than helpful and not apologetic at all.

Does anyone have any input or ideas on this?

    It's the LA wiogs.

    OP you asked about this nearly a month ago, have you contacted the LA and explained why you have not paid? Do you agree the fine is valid, were you aware you had parked incorrectly?

    I haven't asked about this nearly a month ago?! I asked today? I only received it 2weeks ago.

    Re read the post, I didn't receive the fine from my local authority (husband was driving, I was a passenger and he drove in a bus lane)

    My car is a Motability car. Motability have given the local authority my details. Despite the fact that I changed my details as soon as I moved, Motability didn't update my V5 which they keep.

    First-up, who issued this ticket/took action against you - was it a council or private firm. This is of utmost importance in determining what you do next.

    I would agree with you that this is Motability's error - they processed our change of address quickly and I know that they also organised the update of the V5, as I requested a copy of the V5 only a couple of days later (needed by council for parking bay application) and was reminded politely by Motability that they couldn't supply a copy because of the change of address :rotfl: They sent through a copy of the updated V5 about two weeks later.

    However, I don't know whether the issuers of the PCN (presuming it is genuine and not an 'invoice', which is a completely different topic for another board!!) would be interested in Motability's mistake. It may be that you'll have to pay up, and then ask for Motability to recompense you.

    Make an offer to pay original PCN at £30 as you didn't receive it because address change was not processed.

    Bristol Cuty Council. I work for the police so I'm aware which fines have to be paid and which fines aren't actual fines 👍

    It's not my point though. I updated my details with Motability who hold the V5 document for my car because they own it, I hire it from them.
    I cannot access the V5 beaus it's not my property. I updated my address with them but they did not update the V5.

    FINALLY!!!! Someone understands what I'm getting at! I've posted elsewhere about this and others have been rude and abrupt stating its my fault for not updating the V5. I don't often post on here but I'm shocked at how much people get on their high horse without reading what I've written properly!

    Motability own the car so it's them that are recorded as the owners. I am simply the 'keeper' and Motability are responsible for the updating of my details on that form when I contact them to change my details.
    I'm not worried about the PCN. Husband was driving and I was a passenger. He drove in a bus lane! We are happy to accept the contravention pay the £30, but not £97!
