Help!! PCN says appeal has to be w/i 21 days

Hi, I'm a new member (so please excuse my ignorance) and couldn't find an answer to my query on the newbie FAQs.

My mother in-law received a PCN from Vehicle Control Services Ltd as she had forgotten to display her blue badge when she parked on a car park for market/Asda supermarket shoppers. The car park is free for customers and has a number of disabled car spaces.

On the back of the notice it says "Appeals/challenges must be received by the central payments office within twenty one days of the notice issue date. appeals/challenges received after this time will not be considered unless in extreme circumstances and at the company's discretion"

Where I'm confused is, is that on the flowchart it says to wait until a letter is sent to the keeper from the private company that issued the PCN. If my mother in-law does that, does that not negate the chance to appeal if the letter is received from the company to the keeper AFTER the 21 days is up?

My mother in-law is the registered keeper by the way.

Any info would be gratefully received as she has asked me to deal with this for her. She is 76 and very upset by it all, bless her.

    BPA members are 28 days. IPC members 21 days for appeals. However justifiable your case may be VCS will turn down any appeal.
    Your best approach is to write a standard appeal as the NEWBIES but urgently see the store manager and insist they cancel it and get proof in writiting.
    Blue badges have no validity in private car parks and Asda have failed in their duty under the equality act 2010.
    Why Asda have got mixed up with this crowd is beyond me. Smacks of another COOP/CEL saga to me.

    Appeals are 21/28 days (IPC/BPA) from the date of the Notice to Keeper, NOT from the date of the event.

    The IPC have the worst appeals service in the know galaxy ....... the chances of winning are small.

    Opinion is a bit divided on how to deal with them ..... my suggestion is to do the appeals , for several reasons

    one being if IF it gets to court then you will be shown as being reasonable

    a second is it builds up the case against them .... come judgment day!

    The best thing you can do while reading the above is ........

    go back to ASDA and speak with the manager ( not the customer service / desk / counter staff) and demand that he gets this cancelled

    remind him/her that

    the EQUALITY ACT 2010
    means that he/she and ASDA are jointly responsible with the PPC and that if it proceeds any further you will claim against them.

    If the PPC DID take you to court then ASDA will be named and called to give evidence.
