Advice Please

My wife parked in a city centre car park in December 2014 operated by Euro Car Parks. She entered her reg number and the necessary payment and was issued with a 'ticket'. As she walked away from the machine she heard it refund her coins so she repeated the process with the same result; another 'ticket' and a refund. She was approached by two other motorists who told her that they too had been issued 'tickets' and a refund.

Concluding that the machine was somehow faulty she placed one of her tickets on her windscreen and left her car. She returned to it two hours later and drove home. She retained both 'tickets' in case of repercussions and when I examined them I saw that they were, in fact, debit card receipts for two different card transactions timed at 18:03 and 18:06.

The PCN duly landed and she appealed outlining the circumstances, the appeal was refused on the basis that the ANPR camera timed her into the carpark at 18:13 and if the ticket machine was faulty then it was her 'duty' to report it.

She appealed to POPLA who rejected the appeal saying that her 'defence' was no more than mitigation again citing the discrepancies in the 'ticket' times and the 'camera' time and reaffirming the view that she should have reported the faulty machine or parked elsewhere.

I know she will want to pay now but my view is she should stick it out and have her day in court if it comes to that, any advice would be appreciated!

    Of course she should stick it out. Euro is toothless and pathetic, all that will happen is that she'll get a few silly threatograms from debt collectors and then...nothing!

    It would've been so easy to win at PoPLA too.

  • Hiya all I'm a newbie at all this I'm a driver for my mum as she has a dla car. And last week we in Wilkos, car park in castleford Wakefield in a disabled bay with her blue badge, I was only gone 30 mins and you get 3 hrs with.a blue badge and she revieced a letter with her reg number of it. How can they give somebody a fine when nothing was on the car just this letter she has recieved, can anybody give me some advice I have emailed the company as well .
